ENGLISH CHAPTER IINTRODUCTION 1.1 PurposeThese Booking Terms & Conditions ("Terms") govern all enquiries, quotations, bookings, purchases, registrations, and participation in any products or services offered by Sportsmedia Indonesia, a business unit of PT. Fave Global Konsultan ("Sportsmedia Indonesia", "SMI", "FaVe", "we", "our", or "us"). These Terms form a legally binding agreement between Sportsmedia Indonesia and the person, organization, institution, company, school, university, sports club, association, or other legal entity making a booking or purchasing our services ("Customer", "Client", "Traveller", "Participant", "you", or "your"). By submitting an enquiry, accepting a quotation, confirming a booking, making a payment, registering for any program, participating in any activity, or otherwise using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms together with our Privacy Policy and any additional written agreements that may apply to specific services. 1.2 Scope of ServicesThese Terms apply to all products and services offered by Sportsmedia Indonesia, including but not limited to:
Educational Tours;
Sports Tours;
Athlete Management Services;
Athlete Exchange Programs;
International Training Camps;
School and University Tours;
Corporate Travel Programs;
Business Delegations;
Incentive Travel;
Group Travel;
Bespoke Travel Arrangements;
Sporting Events;
International Competitions;
Tournament Participation;
Cultural Exchange Programs;
Hospitality Services;
Event Management;
Sponsorship Programs;
Consultancy Services; and
any other services provided by Sportsmedia Indonesia from time to time.
Certain services may be subject to additional terms, policies, supplier conditions, or contractual agreements, all of which shall be deemed incorporated into these Terms where applicable. 1.3 CapacityA person making a booking represents and warrants that he or she:
is at least eighteen (18) years of age, or otherwise has legal authority to enter into this agreement;
possesses the legal capacity to enter into binding contracts;
has authority to act on behalf of every traveller or participant included in the booking;
has obtained all necessary permissions and consents from parents, legal guardians, employers, schools, clubs, organizations, or other relevant parties where required; and
accepts responsibility for ensuring that all persons included within the booking comply with these Terms.
Where the booking is made on behalf of a company, educational institution, sports organization, government agency, or other legal entity, the individual making the booking warrants that he or she has full authority to legally bind that organization. 1.4 Acceptance of these TermsThese Terms shall become legally effective upon the earliest occurrence of any of the following events:
acceptance of a quotation issued by Sportsmedia Indonesia;
payment of any deposit or other amount requested by Sportsmedia Indonesia;
confirmation of a booking through our website, email, messaging platform, or any electronic booking system;
execution of a written agreement;
participation in any tour, event, competition, training program, consultation, or other service provided by Sportsmedia Indonesia.
Electronic communications, including emails, online booking forms, electronic signatures, digital approvals, messaging applications, and other legally recognized electronic methods, shall constitute valid acceptance of these Terms to the fullest extent permitted under the applicable laws of the Republic of Indonesia. 1.5 Governing Legal FrameworkThese Terms have been prepared in accordance with the applicable laws and regulations of the Republic of Indonesia, including, where relevant:
the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata);
Law No. 8 of 1999 concerning Consumer Protection;
Law No. 27 of 2022 concerning Personal Data Protection;
applicable laws and regulations governing electronic information and electronic transactions;
applicable immigration, customs, taxation, transportation, tourism, and public health regulations; and
other laws and regulations applicable to the services provided by Sportsmedia Indonesia.
Nothing contained in these Terms shall exclude, limit, or waive any rights that cannot legally be excluded under the mandatory laws of the Republic of Indonesia. 1.6 International ServicesMany of our services involve international travel, overseas sporting events, educational programs, training camps, competitions, cultural exchanges, or cooperation with foreign service providers. Accordingly, certain aspects of a booking may also be subject to the mandatory laws, regulations, immigration requirements, customs procedures, health requirements, safety standards, or contractual conditions applicable in the destination country. Customers and travellers remain responsible for ensuring that they comply with all applicable legal requirements imposed by the authorities of the countries they visit. 1.7 Entire AgreementThese Terms, together with our Privacy Policy, booking confirmation, quotation, itinerary, invoice, supplier-specific conditions (where applicable), and any written agreement executed between the parties, constitute the entire agreement governing the relationship between Sportsmedia Indonesia and the Customer. In the event of any inconsistency between these Terms and a separately executed written agreement, the written agreement shall prevail solely to the extent of such inconsistency. 1.8 AmendmentsSportsmedia Indonesia reserves the right to amend, update, modify, or replace these Terms from time to time in order to reflect changes in applicable laws, operational requirements, business practices, supplier arrangements, technological developments, or regulatory obligations. The latest version of these Terms will always be made available on our official website. Amendments shall not affect confirmed bookings unless required by applicable law or expressly agreed by the parties. 1.9 LanguageThese Terms are published in the English language for international accessibility. Where an Indonesian language version is also provided, both versions are intended to convey the same meaning. In the event of any inconsistency arising solely from translation, the Indonesian language version shall prevail to the extent required by the applicable laws of the Republic of Indonesia. 1.10 ContactQuestions regarding these Terms may be submitted to Sportsmedia Indonesia using the contact details published on our official website or through our designated customer service representatives. CHAPTER IIDEFINITIONS Unless the context otherwise requires, the following capitalized terms shall have the meanings set out below: 2.1 "Applicable Laws"means all laws, regulations, governmental decrees, ministerial regulations, administrative rules, court decisions, and other legally binding provisions applicable in the Republic of Indonesia, together with any mandatory laws applicable in the country where the Services are provided. 2.2 "Booking"means any reservation, registration, purchase, enrolment, order, or confirmation made by a Customer for any Service provided by Sportsmedia Indonesia, whether submitted electronically, in writing, verbally, or through an authorised representative. 2.3 "Booking Confirmation"means the written confirmation issued by Sportsmedia Indonesia acknowledging acceptance of a Booking, whether delivered by email, electronic platform, messaging application, or other legally recognised communication method. 2.4 "Business Day"means any day, excluding Saturdays, Sundays, and Indonesian national public holidays, on which commercial banks are generally open for business in Jakarta, Republic of Indonesia. 2.5 "Customer"means any individual, company, educational institution, sports club, association, government agency, legal entity, or other organisation that makes a Booking or purchases Services from Sportsmedia Indonesia. 2.6 "Traveller"means every individual participating in, attending, travelling under, or otherwise receiving the Services provided by Sportsmedia Indonesia. 2.7 "Participant"means any person participating in an educational program, sporting event, competition, training camp, seminar, conference, workshop, cultural exchange, or any other activity organised or facilitated by Sportsmedia Indonesia. 2.8 "Group"means two or more Travellers travelling together under a single Booking or participating in the same programme or event. 2.9 "Group Leader"means the person appointed or authorised to represent a Group and communicate with Sportsmedia Indonesia regarding all matters relating to the Booking. 2.10 "Parent" or "Legal Guardian"means a person legally authorised under Applicable Laws to make decisions on behalf of a minor or person lacking legal capacity. 2.11 "Minor"means any individual who has not yet reached the age of eighteen (18) years, unless another age is prescribed by Applicable Laws. 2.12 "Services"means all products and services offered by Sportsmedia Indonesia, including educational tours, sports tours, athlete management, consultancy, international exchanges, training camps, competitions, group travel, bespoke travel arrangements, event management, sponsorship programmes, hospitality services, and any related services. 2.13 "Quotation"means a written proposal, cost estimate, itinerary, pricing schedule, or commercial offer issued by Sportsmedia Indonesia. 2.14 "Deposit"means the initial payment required to secure or confirm a Booking. 2.15 "Balance Payment"means the remaining amount payable after the Deposit has been paid. 2.16 "Supplier"means any airline, hotel, accommodation provider, transport operator, event organiser, insurance provider, venue operator, activity provider, local partner, government authority, or other third party supplying goods or services relating to a Booking. 2.17 "Third-Party Supplier"means any independent entity that provides products or services connected with the Services but is not owned or controlled by Sportsmedia Indonesia. 2.18 "Travel Documents"means passports, visas, permits, vaccination certificates, health declarations, travel insurance certificates, customs documents, immigration documents, tickets, boarding passes, and any other documents required for travel. 2.19 "Travel Insurance"means an insurance policy covering travel-related risks, including but not limited to medical expenses, accidents, cancellations, delays, personal liability, loss of baggage, or emergency assistance. 2.20 "Force Majeure"means any event beyond the reasonable control of either party that could not reasonably have been anticipated or avoided, including natural disasters, earthquakes, floods, volcanic eruptions, pandemics, epidemics, war, terrorism, civil unrest, strikes, governmental actions, border closures, transportation disruptions, cyber incidents, or any other extraordinary event materially affecting the performance of the Services. 2.21 "Personal Data"means any information relating to an identified or identifiable individual as defined under applicable personal data protection laws. 2.22 "Processing"means any operation performed upon Personal Data including collection, recording, storage, organisation, adaptation, use, disclosure, transmission, transfer, deletion, destruction, or any other form of processing. 2.23 "Privacy Policy"means the Privacy Policy published by Sportsmedia Indonesia, as amended from time to time. 2.24 "Electronic Communication"means any communication transmitted electronically, including email, online booking systems, websites, customer portals, electronic signatures, messaging applications, video conferencing platforms, or other legally recognised electronic communication methods. 2.25 "Website"means the official website operated by or on behalf of Sportsmedia Indonesia, together with any associated online platforms used to provide the Services. 2.26 "Working Itinerary"means the proposed travel schedule, programme outline, or activity plan issued before the final itinerary is confirmed. 2.27 "Final Itinerary"means the confirmed schedule of travel, accommodation, transportation, events, activities, and related arrangements issued by Sportsmedia Indonesia before commencement of the Services. 2.28 "Event"means any sporting event, educational programme, conference, seminar, workshop, tournament, exhibition, cultural exchange, or other organised activity provided by Sportsmedia Indonesia. 2.29 "Written Notice"means any notice provided in writing, whether delivered by email, courier, registered mail, electronic document, or any other legally recognised communication method. 2.30 "Agreement"means these Booking Terms & Conditions together with the Booking Confirmation, Quotation, Final Itinerary, Privacy Policy, invoices, supplier-specific conditions, and any separate written agreement executed between the parties, all of which collectively constitute the legally binding agreement between Sportsmedia Indonesia and the Customer.
CHAPTER IIIBOOKING AND CONTRACT FORMATION 3.1 EnquiriesAny enquiry submitted to Sportsmedia Indonesia, whether through our website, email, telephone, social media, messaging applications, or any other communication channel, shall not constitute a confirmed Booking or create any contractual obligation unless and until accepted by Sportsmedia Indonesia in accordance with these Terms. Information provided during the enquiry stage, including itineraries, schedules, availability, pricing, and promotional materials, is provided for general information purposes only and may be amended without prior notice. 3.2 QuotationsAll quotations issued by Sportsmedia Indonesia are based on the information available at the time they are prepared and are subject to availability, supplier confirmation, exchange rate fluctuations, government regulations, taxes, transportation costs, and other relevant commercial considerations. Unless otherwise stated in writing, quotations shall remain valid for the period specified in the quotation. Upon expiry of such validity period, Sportsmedia Indonesia reserves the right to revise pricing, availability, or other commercial terms.The issuance of a quotation shall not create any obligation on Sportsmedia Indonesia to accept a Booking. 3.3 Booking RequestA Booking may be submitted by completing an online booking form, signing a booking document, sending written confirmation by email, communicating through an authorised electronic platform, or by any other method approved by Sportsmedia Indonesia. The Customer shall ensure that all information submitted during the booking process is complete, accurate, and current.Sportsmedia Indonesia shall not be responsible for any losses, delays, penalties, or additional costs resulting from incomplete, inaccurate, or misleading information provided by the Customer. 3.4 Formation of ContractA legally binding agreement between Sportsmedia Indonesia and the Customer shall only be formed when:
Sportsmedia Indonesia issues a Booking Confirmation;
The required Deposit or full payment has been received (where applicable);
Sportsmedia Indonesia expressly confirms acceptance of the Booking in writing; or
Both parties execute a separate written agreement.
Until one of the above events has occurred, Sportsmedia Indonesia reserves the right to decline or withdraw any quotation or proposed booking without liability.
3.5 Authority of the CustomerWhere one person makes a Booking on behalf of other Travellers, organisations, schools, sports clubs, government agencies, companies, or any other entity, that person represents and warrants that he or she has full authority to:
enter into this Agreement;
accept these Terms on behalf of all participants;
receive communications relating to the Booking;
make decisions concerning amendments, cancellations, refunds, or other administrative matters; and
make payments on behalf of the Group where applicable.
All Travellers included within the Booking shall be deemed to have accepted these Terms. 3.6 Accuracy of InformationThe Customer is responsible for ensuring that all personal details, travel documents, participant information, medical declarations, passport details, visa information, emergency contacts, and any other information submitted to Sportsmedia Indonesia are complete and accurate. Any costs arising from incorrect or incomplete information, including airline amendment fees, visa reapplications, accommodation penalties, transportation charges, or administrative costs, shall be borne by the Customer. 3.7 AvailabilityAll bookings remain subject to availability of flights, accommodation, transportation, sporting events, educational institutions, venues, local partners, government approvals, and third-party suppliers. Sportsmedia Indonesia does not guarantee availability until a Booking Confirmation has been issued. 3.8 Electronic TransactionsThe Customer acknowledges and agrees that electronic communications, including but not limited to emails, online booking systems, electronic signatures, scanned signed documents, digital approvals, customer portals, messaging applications, and other legally recognised electronic communications, shall have the same legal force and effect as written documents to the fullest extent permitted under the applicable laws of the Republic of Indonesia. Electronic records maintained by Sportsmedia Indonesia may be relied upon as evidence of communications and contractual arrangements. 3.9 Booking ConfirmationFollowing acceptance of a Booking, Sportsmedia Indonesia will issue a Booking Confirmation summarising the principal details of the Services. The Customer must review the Booking Confirmation immediately upon receipt. Any discrepancies, omissions, spelling errors, incorrect participant names, travel dates, destinations, passport details, or other inaccuracies must be notified to Sportsmedia Indonesia in writing without undue delay.Failure to notify Sportsmedia Indonesia of such errors may result in amendment fees or additional charges imposed by third-party suppliers. 3.10 DepositSportsmedia Indonesia may require a Deposit to secure a Booking. The amount, due date, payment schedule, and applicable conditions shall be specified in the relevant quotation, invoice, proposal, or written agreement. Payment of a Deposit constitutes acceptance of these Terms. Unless otherwise agreed in writing, Deposits are non-refundable except where required by applicable law. 3.11 Final PaymentThe balance of the Booking Price must be paid by the due date stated in the invoice or Booking Confirmation. Failure to make payment by the due date may result in cancellation of the Booking without further notice. Sportsmedia Indonesia reserves the right to impose late payment charges, suspend Services, or release reserved arrangements where payment is overdue. 3.12 Payment MethodsPayments may be made using any payment method approved by Sportsmedia Indonesia, including bank transfer, virtual account, payment gateway, debit card, credit card, or other electronic payment systems. The Customer shall bear any bank charges, transfer fees, currency conversion fees, payment gateway fees, or other financial institution charges unless otherwise agreed in writing. 3.13 CurrencyUnless otherwise stated, all quotations and invoices shall be issued in Indonesian Rupiah (IDR). Where quotations are issued in foreign currencies, exchange rate fluctuations occurring before payment is received may affect the final amount payable. Sportsmedia Indonesia reserves the right to adjust pricing where exchange rate movements materially affect the cost of providing the Services. 3.14 Taxes and Government ChargesUnless expressly stated otherwise, all prices are exclusive of taxes, government levies, visa fees, customs duties, airport taxes, tourism levies, service charges, or other governmental charges imposed after the date of quotation. Where additional taxes or mandatory governmental charges become payable after confirmation of the Booking, Sportsmedia Indonesia reserves the right to recover such amounts from the Customer. 3.15 Promotional OffersPromotional prices, discounts, early-bird offers, sponsorship arrangements, corporate packages, or special campaigns shall be subject to the specific terms applicable to the relevant promotion. Promotional offers may not be combined unless expressly stated otherwise. 3.16 Customer Responsibility Prior to DeparturePrior to the commencement of the Services, the Customer shall ensure that all payments have been completed and that every Traveller possesses valid travel documentation, visas, permits, insurance, health certificates, vaccinations, and any other documents required by the destination country or relevant authorities. Failure to satisfy such requirements shall not constitute grounds for cancellation without applicable cancellation charges. 3.17 Right to Refuse a BookingSportsmedia Indonesia reserves the right, acting reasonably and in accordance with applicable law, to decline any Booking where:
required payments are not received;
requested Services are unavailable;
fraudulent or misleading information has been provided;
participation may endanger the safety, security, reputation, or operational integrity of Sportsmedia Indonesia, other Travellers, suppliers, or partner organisations;
acceptance of the Booking would violate any Applicable Laws, governmental restrictions, sanctions, or regulatory requirements.
Where a Booking is declined before a contract is formed, Sportsmedia Indonesia shall refund any monies received, less any non-recoverable third-party costs already incurred, where legally permissible. 3.18 No WaiverFailure or delay by Sportsmedia Indonesia to exercise any right under these Terms shall not constitute a waiver of that right, nor shall any partial exercise prevent any subsequent exercise of the same or any other right. CHAPTER IVPRICES AND PAYMENT 4.1 PricingAll prices quoted by Sportsmedia Indonesia are based on the information, supplier costs, exchange rates, government charges, taxes, transportation costs, accommodation rates, venue availability, and other commercial factors applicable at the time the quotation is prepared. Unless otherwise expressly stated in writing, all prices are subject to change prior to the formation of a binding contract in accordance with Chapter III of these Terms. 4.2 Quotation CurrencyUnless otherwise specified, quotations and invoices shall be issued in Indonesian Rupiah (IDR).For international programmes or services involving overseas suppliers, quotations may be issued in another currency where commercially appropriate. Where payment is made in a different currency, the applicable exchange rate and any currency conversion costs shall be borne by the Customer unless otherwise agreed in writing. 4.3 Price InclusionsThe Booking Confirmation, quotation, itinerary, proposal, or written agreement shall specify the services included within the Booking Price. Unless expressly stated otherwise, the Booking Price shall not include:
passport fees;
visa application fees;
travel insurance;
vaccination or medical costs;
airport taxes not already included in airline tickets;
customs duties;
excess baggage charges;
optional activities;
personal expenses;
bank charges;
currency conversion fees;
gratuities or tips;
hotel security deposits;
costs arising from changes requested by the Customer; and
any other expenses not expressly included within the quotation.
4.4 Deposit RequirementSportsmedia Indonesia may require a Deposit to secure reservations with airlines, hotels, educational institutions, sporting organisations, event organisers, transportation providers, or other suppliers. The amount of the Deposit shall be determined according to the nature of the Services and shall be stated in the quotation, invoice, or written agreement. Unless otherwise agreed, a Booking shall not be considered confirmed until the required Deposit has been received. 4.5 Payment ScheduleThe Customer shall make all payments in accordance with the payment schedule specified in the Booking Confirmation, quotation, invoice, or written agreement. Where instalment payments are permitted, each instalment shall be paid on or before its respective due date. Failure to comply with the agreed payment schedule may result in suspension or cancellation of the Booking. 4.6 Final PaymentThe outstanding balance must be received by Sportsmedia Indonesia no later than the due date specified in the Booking Confirmation or invoice. Failure to pay the outstanding balance by the due date may entitle Sportsmedia Indonesia, without prejudice to its other rights, to:
cancel the Booking;
release reserved flights, accommodation, venues, or other arrangements;
impose late payment charges where permitted by law;
recover any losses or costs incurred as a result of such non-payment.
4.7 Late PaymentsWhere payment is overdue, Sportsmedia Indonesia reserves the right to suspend the provision of Services until payment has been received. If Sportsmedia Indonesia incurs additional costs arising from delayed payment, including supplier penalties, exchange rate losses, administrative expenses, legal costs, or financing charges, such costs may be charged to the Customer where permitted by applicable law. 4.8 Price Adjustments After Booking ConfirmationAlthough Sportsmedia Indonesia aims to maintain the confirmed Booking Price, adjustments may become necessary where significant increases occur due to circumstances beyond our reasonable control, including but not limited to:a. changes in government taxes or levies;b. fuel surcharges;c. airport charges;d. airline or transportation operator surcharges;e. accommodation rate increases imposed by suppliers;f. significant currency exchange fluctuations;g. changes in visa fees or government charges;h. newly imposed regulatory requirements. Where any such adjustment becomes necessary, Sportsmedia Indonesia shall notify the Customer as soon as reasonably practicable together with supporting information where appropriate. 4.9 Customer-Requested ChangesAny amendment requested by the Customer after Booking Confirmation may result in additional charges imposed by airlines, hotels, event organisers, educational institutions, transportation providers, visa authorities, or other suppliers.Sportsmedia Indonesia may also charge a reasonable administration fee for processing such amendments. 4.10 TaxesUnless otherwise stated, all prices shall be exclusive of applicable taxes. Where Indonesian Value Added Tax (VAT/PPN), withholding tax, tourism taxes, airport charges, or any other mandatory government charges become payable, the Customer shall pay such amounts unless expressly included within the quotation. 4.11 Third-Party ChargesSportsmedia Indonesia shall not be responsible for pricing changes imposed directly by independent third-party suppliers after the Booking has been confirmed. Where supplier charges become unavoidable in order to maintain the Booking, Sportsmedia Indonesia shall promptly inform the Customer and seek appropriate instructions before proceeding wherever reasonably practicable. 4.12 Bank ChargesAll payments shall be made free and clear of any deductions. The Customer shall bear all bank transfer fees, intermediary bank charges, foreign exchange conversion fees, payment gateway charges, credit card processing fees, or similar financial charges unless otherwise agreed in writing. 4.13 Promotional PricingAny promotional pricing, discounts, sponsorship arrangements, educational packages, early booking incentives, or special offers shall apply only during the stated promotional period and shall remain subject to their respective terms and conditions. Promotional pricing cannot be combined with any other offer unless expressly stated. 4.14 Government ChargesShould any government authority introduce new taxes, duties, tourism levies, health requirements, security charges, customs fees, immigration fees, or other mandatory charges after the Booking Confirmation has been issued, Sportsmedia Indonesia reserves the right to recover such additional costs from the Customer where permitted by applicable law. 4.15 RefundsAny refund shall be processed in accordance with these Terms, the applicable cancellation provisions, supplier policies, and the terms of any separate written agreement. Refund processing times may vary depending upon the policies of airlines, hotels, financial institutions, payment gateways, government authorities, or other suppliers. Sportsmedia Indonesia shall not be responsible for delays in refunds caused by third-party financial institutions or suppliers beyond our reasonable control. 4.16 No Set-OffUnless required by applicable law or agreed in writing, the Customer shall not withhold payment, deduct, set off, or counterclaim any amount payable to Sportsmedia Indonesia against any alleged claim or dispute. 4.17 Payment ConfirmationThe Customer is responsible for ensuring that all payments have been successfully received by Sportsmedia Indonesia.Proof of payment should be retained until written confirmation of receipt has been issued by Sportsmedia Indonesia. Sportsmedia Indonesia reserves the right to request additional payment verification where reasonably necessary for fraud prevention, regulatory compliance, or financial security purposes. 4.18 Financial ComplianceSportsmedia Indonesia reserves the right to refuse, suspend, delay, or cancel any transaction where reasonably necessary to comply with applicable anti-money laundering laws, anti-corruption regulations, financial sanctions, fraud prevention measures, or other legal obligations imposed by competent authorities. Any such action shall be undertaken in accordance with applicable law and shall not constitute a breach of these Terms. CHAPTER VCHANGES REQUESTED BY THE CUSTOMER 5.1 Customer Requests for ChangesFollowing the Booking Confirmation, the Customer may request changes to the Booking by submitting a written request to Sportsmedia Indonesia. All requests for amendments shall be subject to availability, supplier approval, operational feasibility, and these Terms.Sportsmedia Indonesia shall use reasonable efforts to accommodate such requests but cannot guarantee that any requested amendment can be implemented. 5.2 Types of AmendmentsCustomer-requested amendments may include, but are not limited to:
changes to travel dates;
changes to destinations;
changes to flights;
accommodation upgrades or downgrades;
transportation arrangements;
participant names;
reduction or increase in participant numbers;
sporting event registrations;
educational programme changes;
itinerary revisions;
optional activities;
room allocations;
meal requirements; and
any other modification requested by the Customer.
5.3 Amendment RequestsAll amendment requests must be submitted in writing by the Customer or the authorised Group Leader. Sportsmedia Indonesia may require sufficient supporting information before processing any amendment request. No amendment shall be deemed accepted until confirmed in writing by Sportsmedia Indonesia. 5.4 Amendment FeesCustomer-requested amendments may result in additional costs, including but not limited to:a. airline amendment fees;b. accommodation amendment charges;c. transportation provider charges;d. visa administration costs;e. event organiser fees;f. educational institution charges;g. supplier penalties;h. administrative fees charged by Sportsmedia Indonesia. The Customer shall be responsible for all such costs. 5.5 Name ChangesRequests to change the name of a Traveller are subject to the rules of the relevant airline, hotel, supplier, government authority, sporting organisation, educational institution, or other applicable third party. Certain suppliers may prohibit name changes or require cancellation and rebooking. Sportsmedia Indonesia accepts no responsibility where such restrictions are imposed by third-party suppliers. 5.6 Reduction in Participant NumbersWhere the Customer reduces the number of participants after Booking Confirmation, the total Booking Price may be recalculated. The Customer shall remain responsible for any cancellation charges, minimum group charges, supplier penalties, or contractual commitments resulting from such reduction. 5.7 Increase in Participant NumbersAdditional participants shall be accepted only where availability exists. Sportsmedia Indonesia cannot guarantee that additional participants will receive identical pricing, accommodation, transportation, seating arrangements, event access, or travel schedules as originally booked. 5.8 Changes Requested Close to DepartureRequests submitted shortly before departure may not be possible due to supplier deadlines, ticket issuance, immigration requirements, accommodation allocations, transportation schedules, or operational limitations. Where urgent amendments are accepted, additional priority processing charges may apply. 5.9 Government RequirementsWhere amendments become necessary due to new immigration rules, visa requirements, customs procedures, health regulations, security measures, or other governmental requirements, Sportsmedia Indonesia shall cooperate with the Customer to implement the required changes where reasonably practicable. Any resulting costs shall be borne by the Customer unless otherwise required by applicable law. 5.10 Exchange Rate AdjustmentsWhere a requested amendment results in additional services purchased in foreign currencies, Sportsmedia Indonesia reserves the right to calculate the additional cost using the applicable exchange rate prevailing at the time the amendment is confirmed. 5.11 Amendment Processing TimeSportsmedia Indonesia shall process amendment requests as promptly as reasonably practicable. Processing times may depend upon the response times of airlines, hotels, educational institutions, sporting organisations, embassies, government authorities, local partners, and other third-party suppliers. Sportsmedia Indonesia shall not be liable for delays caused by such third parties. 5.12 Effect on ItineraryAn approved amendment may affect the overall itinerary, transportation schedules, accommodation arrangements, event participation, pricing, or other components of the Booking. The Customer acknowledges that consequential changes may be necessary in order to implement the requested amendment. 5.13 Non-TransferabilityUnless otherwise agreed in writing, a confirmed Booking may not be transferred to another person, organisation, or legal entity. Any transfer shall remain subject to supplier approval and any applicable administrative or supplier charges. 5.14 Customer ResponsibilityThe Customer remains responsible for verifying that any amendment requested is accurate before confirmation. Sportsmedia Indonesia shall not be responsible for losses arising from incorrect instructions provided by the Customer or Group Leader. 5.15 Amendment ConfirmationNo amendment shall become effective until Sportsmedia Indonesia has issued written confirmation setting out the revised Booking details and any additional charges payable. Where additional payment is required, Sportsmedia Indonesia may suspend implementation of the requested amendment until such payment has been received. 5.16 Supplier RefusalWhere an airline, hotel, educational institution, sporting organisation, government authority, visa office, transportation provider, or other third-party supplier refuses a requested amendment, Sportsmedia Indonesia shall not be liable for any resulting loss, provided that reasonable efforts have been made to facilitate the request. 5.17 Changes Constituting a CancellationCertain amendment requests may be regarded by suppliers as a cancellation of the original Booking followed by a new Booking. Where this occurs, the applicable cancellation charges and the pricing applicable to the new Booking shall apply.Sportsmedia Indonesia shall notify the Customer before proceeding wherever reasonably practicable. 5.18 Entire AmendmentAny approved amendment shall form part of the Agreement and shall be read together with these Terms, the Booking Confirmation, itinerary, quotation, invoice, and any other relevant contractual documents. 5.19 Sponsorship, Federation, and Institutional AmendmentsWhere a Booking is funded, sponsored, coordinated, or otherwise supported by a sponsor, educational institution, university, sports federation, National Olympic Committee, government authority, corporate entity, non-governmental organization, or any other third-party institution, any request for amendments shall be submitted by the duly authorised representative of such institution or by the Customer authorised to act on its behalf. Sportsmedia Indonesia may require written evidence of such authority before processing any amendment request.Any amendment requested by a sponsoring or funding organisation shall remain subject to supplier approval, operational feasibility, applicable laws, and these Terms. Unless otherwise agreed in writing, the sponsoring or funding organisation shall remain responsible for any additional costs, supplier charges, administrative fees, cancellation charges, or other financial obligations arising directly from the requested amendment. Where an amendment affects the participation of individual Travellers, Sportsmedia Indonesia may require the written acknowledgement or consent of the affected Traveller, parent or legal guardian (where applicable), or other authorised representative, where reasonably necessary or required by applicable law. Nothing in this Clause shall obligate Sportsmedia Indonesia to implement any amendment that is unlawful, impracticable, inconsistent with supplier requirements, or likely to adversely affect the safety, security, operational integrity, or contractual obligations relating to the Booking. CHAPTER VICANCELLATION BY THE CUSTOMER 6.1 Customer's Right to CancelThe Customer may cancel a Booking at any time by submitting written notice to Sportsmedia Indonesia. A cancellation shall only become effective upon receipt of the written cancellation notice by Sportsmedia Indonesia. For the avoidance of doubt, verbal conversations, telephone calls, or informal communications shall not constitute a valid cancellation unless subsequently confirmed in writing. 6.2 Cancellation by the Group LeaderWhere a Booking has been made on behalf of a Group, any cancellation request shall be submitted by the authorised Group Leader or other duly authorised representative. Sportsmedia Indonesia shall be entitled to rely upon such instructions unless notified otherwise in writing. 6.3 Effective Date of CancellationThe effective date of cancellation shall be the date on which Sportsmedia Indonesia receives the written cancellation notice during normal Business Days. Cancellation notices received outside normal Business Days shall be deemed received on the next Business Day. 6.4 Cancellation ChargesCancellation charges may apply depending upon:
the timing of the cancellation;
supplier terms and conditions;
airline fare rules;
accommodation policies;
event organiser requirements;
educational institution policies;
government fees;
visa processing status;
and any other costs already incurred by Sportsmedia Indonesia.
The applicable cancellation charges shall be communicated to the Customer wherever reasonably practicable. 6.5 Non-Refundable CostsThe Customer acknowledges that certain payments are non-refundable, including but not limited to:
airline tickets issued on non-refundable fares;
visa application fees;
passport fees;
travel insurance premiums;
government charges;
event registration fees;
tournament entry fees;
supplier deposits designated as non-refundable;
administrative fees already incurred; and
any other non-recoverable third-party costs.
Such costs shall remain payable regardless of the reason for cancellation. 6.6 Partial CancellationWhere one or more Travellers cancel while the remaining Group continues with the Booking, Sportsmedia Indonesia reserves the right to recalculate:
accommodation costs;
transportation costs;
group discounts;
room occupancy rates;
supplier pricing;
and any other pricing components affected by the reduced group size.
The remaining Travellers may therefore become liable for additional costs. 6.7 Cancellation After Services Have CommencedWhere a Traveller voluntarily leaves a tour, training camp, sporting event, educational programme, or other Service after its commencement, no refund shall normally be payable for any unused accommodation, transportation, meals, activities, tickets, or other arrangements. Any additional costs incurred in connection with the Traveller's early departure shall be borne by the Customer unless otherwise agreed in writing. 6.8 Failure to TravelWhere a Traveller fails to arrive at the designated departure point, misses a flight, is denied boarding, fails to obtain a required visa, lacks valid travel documentation, or otherwise becomes unable to participate due to circumstances within their own control, such circumstances shall be treated as a cancellation by the Customer. Applicable cancellation charges shall apply. 6.9 Medical ReasonsWhere cancellation occurs due to illness, injury, medical conditions, or other health-related reasons, any refund shall remain subject to:
these Terms;
applicable supplier policies;
the terms of any travel insurance policy; and
any mandatory legal requirements.
Sportsmedia Indonesia recommends that all Travellers obtain comprehensive travel insurance covering cancellation due to medical circumstances. 6.10 Force Majeure Affecting the CustomerWhere the Customer is unable to travel due to a Force Majeure event affecting the Customer personally, Sportsmedia Indonesia shall consider each case individually. Any refund, credit, postponement, or alternative arrangement shall remain subject to supplier recoveries, applicable law, and commercial feasibility. 6.11 Refund ProcessingWhere a refund is payable, Sportsmedia Indonesia shall process the refund within a reasonable period after:
confirming the amount recoverable;
receiving refunds from relevant suppliers where applicable; and
completing any necessary financial or administrative procedures.
Refund processing times may vary depending on banks, payment gateways, airlines, hotels, government authorities, and other third-party suppliers. 6.12 Customer ResponsibilityThe Customer remains responsible for all financial obligations arising prior to the effective date of cancellation. Cancellation shall not release the Customer from liability for any outstanding amounts already due under the Agreement. 6.13 Promotional BookingsBookings made under promotional campaigns, sponsorship programmes, educational grants, discounted packages, or special pricing arrangements may be subject to separate cancellation conditions. Such conditions shall prevail to the extent of any inconsistency with this Chapter. 6.14 Travel Insurance ClaimsWhere cancellation is covered under a travel insurance policy, the Customer shall be responsible for submitting any insurance claim directly to the insurer. Sportsmedia Indonesia may, upon reasonable request, provide supporting documentation required for such claim but accepts no responsibility for the insurer's assessment or decision. 6.15 Customer DefaultSportsmedia Indonesia may treat the Booking as cancelled by the Customer where the Customer:
fails to make payment in accordance with the agreed schedule;
fails to provide required documentation within the specified timeframe;
repeatedly fails to respond to reasonable requests necessary to facilitate the Booking;
provides false, inaccurate, or misleading information materially affecting the Booking; or
otherwise commits a material breach of these Terms.
In such circumstances, applicable cancellation charges shall apply. 6.16 No Automatic Right to CompensationCancellation by the Customer shall not give rise to any automatic right to compensation, damages, loss of enjoyment, indirect loss, consequential loss, or reimbursement beyond the amounts recoverable under these Terms, applicable law, and supplier policies. 6.17 Future Travel CreditAt its sole discretion and without creating any legal obligation to do so, Sportsmedia Indonesia may offer a Future Travel Credit, rebooking option, or alternative arrangement instead of a cash refund where commercially appropriate. Any such credit shall remain subject to the conditions communicated at the time of issue. 6.18 SurvivalCancellation of a Booking shall not affect any rights, obligations, liabilities, payment obligations, confidentiality provisions, data protection obligations, dispute resolution procedures, or other provisions which by their nature are intended to survive termination of the Agreement. CHAPTER VIICHANGES OR CANCELLATION BY SPORTSMEDIA INDONESIA 7.1 Right to Amend ServicesSportsmedia Indonesia reserves the right to make reasonable changes to any Booking where such changes are necessary due to operational requirements, safety considerations, supplier availability, governmental requirements, Force Majeure events, or other circumstances beyond our reasonable control. Where reasonably practicable, Sportsmedia Indonesia will notify the Customer as soon as possible of any significant changes. 7.2 Minor ChangesMinor changes may include, but are not limited to:
adjustments to flight schedules;
changes in transportation providers;
substitutions of accommodation of a comparable standard;
modifications to meal arrangements;
revisions to activity schedules;
changes in venues;
adjustments to tour sequencing; or
other operational changes that do not materially affect the overall nature of the Services.
Minor changes shall not entitle the Customer to cancel the Booking or claim compensation unless otherwise required by applicable law. 7.3 Significant ChangesWhere Sportsmedia Indonesia becomes aware of a significant change that materially affects the principal characteristics of the Services, we shall notify the Customer as soon as reasonably practicable. Depending on the circumstances, Sportsmedia Indonesia may offer one or more of the following options:a. acceptance of the revised arrangements;b. alternative Services of comparable value where reasonably available;c. postponement of the Booking;d. a partial or full refund of recoverable amounts, subject to supplier recoveries and applicable law. 7.4 Cancellation by Sportsmedia IndonesiaSportsmedia Indonesia reserves the right to cancel a Booking before the commencement of the Services where:a. the minimum number of participants required for the programme has not been achieved;b. a Force Majeure event prevents the safe or lawful delivery of the Services;c. government authorities impose restrictions affecting the Services;d. suppliers withdraw essential services;e. continued performance of the Agreement would be unlawful or impossible; orf. the Customer commits a material breach of these Terms. 7.5 Minimum Participant RequirementsCertain educational tours, sports tours, competitions, training camps, exchange programmes, or other group activities require a minimum number of participants. Where the required minimum number is not achieved, Sportsmedia Indonesia may cancel or reschedule the programme.In such circumstances, the Customer shall be notified as soon as reasonably practicable. 7.6 Alternative ArrangementsWhere reasonably possible, Sportsmedia Indonesia may offer alternative travel arrangements, revised itineraries, substitute accommodation, replacement transportation, alternative venues, revised schedules, or comparable Services.The Customer shall notify Sportsmedia Indonesia within the timeframe specified whether such alternatives are accepted. 7.7 Supplier-Initiated ChangesSportsmedia Indonesia shall not be responsible for changes made directly by airlines, hotels, educational institutions, sporting organisations, event organisers, transportation providers, or other independent third-party suppliers. Where such changes materially affect the Booking, Sportsmedia Indonesia shall use reasonable efforts to assist the Customer in obtaining suitable alternative arrangements. 7.8 Sporting Events and CompetitionsThe Customer acknowledges that sporting events, tournaments, competitions, training camps, and related activities may be postponed, relocated, cancelled, or modified by the relevant governing body, organiser, federation, league, or venue operator. Sportsmedia Indonesia shall not be liable for such decisions but shall use reasonable efforts to assist the Customer in managing the consequences of such changes. 7.9 Educational InstitutionsEducational institutions, schools, universities, training centres, academies, and host organisations may amend schedules, course content, venue availability, accommodation arrangements, or programme activities. Sportsmedia Indonesia shall not be liable for such institutional decisions provided reasonable alternative arrangements are offered where practicable. 7.10 Government ActionsWhere any government authority introduces or modifies laws, regulations, visa requirements, customs procedures, immigration rules, health measures, public safety requirements, sanctions, border controls, or travel restrictions affecting the Services, Sportsmedia Indonesia may amend, postpone, suspend, or cancel the Booking as reasonably necessary. 7.11 Customer NotificationSportsmedia Indonesia shall provide notice of significant changes or cancellation using the contact details provided by the Customer. The Customer is responsible for ensuring that such contact information remains accurate and up to date. 7.12 RefundsWhere Sportsmedia Indonesia cancels a Booking for reasons other than the Customer's breach of these Terms, any refund shall be limited to recoverable amounts received by Sportsmedia Indonesia after deduction of any non-recoverable costs already paid or committed to third-party suppliers, unless otherwise required by applicable law. 7.13 No Liability for Indirect LossExcept where prohibited by applicable law, Sportsmedia Indonesia shall not be liable for indirect, incidental, consequential, special, or economic losses arising from any amendment or cancellation, including loss of profit, business opportunities, goodwill, anticipated savings, sponsorship, or reputation. 7.14 Customer CooperationThe Customer agrees to cooperate reasonably with Sportsmedia Indonesia in implementing any necessary amendments, including providing updated travel documents, revised participant information, additional approvals, or other documentation reasonably required. 7.15 Force MajeureWhere amendments or cancellations arise from a Force Majeure event, the rights and obligations of both parties shall be governed by Chapter XIV (Force Majeure) of these Terms. 7.16 Good FaithSportsmedia Indonesia shall exercise its rights under this Chapter reasonably, in good faith, and with due regard to the legitimate interests of the Customer, while taking into account safety, legal compliance, supplier obligations, and operational requirements. 7.17 SurvivalAny amendment or cancellation under this Chapter shall not affect the continued operation of those provisions of the Agreement which by their nature are intended to survive, including provisions relating to payment obligations, confidentiality, personal data protection, limitation of liability, dispute resolution, and governing law. CHAPTER VIIITRAVEL DOCUMENTS, PASSPORT, VISA, AND ENTRY REQUIREMENTS 8.1 Customer ResponsibilityThe Customer and each Traveller shall be solely responsible for obtaining, maintaining, and presenting all valid travel documents required for the Services, including but not limited to:
passports;
visas;
residence permits;
entry permits;
transit visas;
vaccination certificates;
health declarations;
customs declarations;
immigration documents; and
any other documents required by the relevant authorities.
Failure to possess valid documentation shall not relieve the Customer from any payment obligations under these Terms. 8.2 Passport ValidityEach Traveller is responsible for ensuring that his or her passport remains valid for the period required by the destination country, transit country, airline, or other relevant authority. Many countries require passports to remain valid for at least six (6) months beyond the intended date of departure.Sportsmedia Indonesia strongly recommends that Customers verify the applicable passport validity requirements before confirming a Booking. 8.3 Visa RequirementsVisa requirements vary depending upon nationality, destination, purpose of travel, duration of stay, and applicable immigration regulations. Unless expressly agreed otherwise in writing, obtaining visas shall remain the sole responsibility of the Customer.Where Sportsmedia Indonesia provides visa assistance, such assistance shall not constitute a guarantee that any visa application will be approved. 8.4 Immigration DecisionsThe decision to permit or refuse entry into any country rests solely with the relevant immigration authority.Sportsmedia Indonesia shall not be liable where a Traveller is refused:
a visa;
entry clearance;
transit permission;
border admission;
customs clearance; or
permission to remain in any country.
Any resulting costs shall remain the responsibility of the Customer. 8.5 Accuracy of Travel DocumentsThe Customer shall ensure that all names, passport numbers, dates of birth, nationality details, visa information, and other travel documentation submitted to Sportsmedia Indonesia exactly match the official documents of each Traveller.Any correction requested after tickets or travel documents have been issued may result in additional supplier charges. 8.6 Health RequirementsThe Customer shall ensure that every Traveller complies with all applicable health requirements imposed by the destination country, airlines, educational institutions, sporting organisations, government authorities, or public health agencies. Such requirements may include:
mandatory vaccinations;
health certificates;
medical declarations;
infectious disease screening;
quarantine requirements;
travel health insurance; or
other public health measures.
8.7 Customs and BiosecurityTravellers are responsible for complying with all customs, quarantine, biosecurity, agricultural import, export, and prohibited goods regulations applicable in each country visited. Sportsmedia Indonesia accepts no responsibility for items confiscated, fines imposed, delays experienced, or penalties arising from non-compliance with such regulations. 8.8 Entry RestrictionsCertain destinations may impose restrictions based on nationality, residency status, criminal history, health conditions, previous immigration records, sanctions, or other legal considerations. The Customer acknowledges that Sportsmedia Indonesia has no control over such governmental decisions. 8.9 Changes in Government RequirementsImmigration, visa, customs, public health, security, and border control requirements may change at any time before or during travel. The Customer remains responsible for monitoring such changes and complying with all updated governmental requirements. Where reasonably practicable, Sportsmedia Indonesia may provide general travel information; however, such information is provided for guidance only and should not be regarded as legal or immigration advice. 8.10 Refusal of BoardingAirlines or transportation providers may refuse boarding where a Traveller fails to satisfy applicable documentation, security, health, or operational requirements. Sportsmedia Indonesia shall not be liable for any costs, losses, delays, or missed travel arrangements resulting from such refusal. 8.11 Minors Travelling InternationallyWhere a Minor participates in international travel, the Customer shall ensure that all parental consents, guardianship documents, travel authorisations, court orders (where applicable), and other legally required documentation have been obtained before departure. Sportsmedia Indonesia may request copies of such documents before confirming travel arrangements. 8.12 Sporting and Educational DocumentationCertain sporting events, educational programmes, competitions, training camps, or exchange programmes may require additional documentation, including:
invitation letters;
eligibility certificates;
federation approvals;
student enrolment confirmations;
academic records;
medical clearances;
anti-doping declarations; or
other documents required by organisers or governing bodies.
The Customer remains responsible for obtaining such documentation unless otherwise agreed in writing. 8.13 Lost or Damaged Travel DocumentsSportsmedia Indonesia shall not be responsible for any loss, theft, damage, expiry, or destruction of passports, visas, travel documents, or personal identification documents belonging to any Traveller. Any replacement costs, emergency travel documents, or additional expenses shall remain the responsibility of the Traveller unless caused directly by the negligence of Sportsmedia Indonesia. 8.14 Government InvestigationsWhere government authorities conduct customs inspections, immigration investigations, health examinations, security screenings, or law enforcement procedures involving a Traveller, Sportsmedia Indonesia shall reasonably cooperate with the relevant authorities where required by law. Any delay, detention, refusal of entry, deportation, penalties, or legal consequences arising from the Traveller's personal circumstances shall remain the responsibility of the Traveller. 8.15 Compliance with Applicable LawsEach Traveller shall comply with all applicable laws, regulations, customs requirements, immigration rules, public health measures, security procedures, and lawful directions issued by competent authorities in every country visited. Failure to comply with such requirements may result in refusal of travel, cancellation of services, removal from the programme, fines, detention, deportation, or other legal consequences for which Sportsmedia Indonesia shall not be responsible. 8.16 Travel AdvisoriesSportsmedia Indonesia may provide general information regarding travel advisories, safety notices, or destination updates where considered appropriate. Such information is provided solely as a courtesy and should not be interpreted as official governmental advice. Customers are encouraged to consult the relevant embassy, consulate, immigration authority, public health authority, or other competent governmental agency before departure. 8.17 No WarrantySportsmedia Indonesia makes no representation or warranty that any Traveller will obtain a visa, immigration clearance, customs approval, entry permit, or permission to participate in any programme where such approval is subject to the discretion of governmental authorities or independent third parties. 8.18 Continuing ResponsibilityThe obligations set out in this Chapter shall continue throughout the duration of the Booking and remain the responsibility of the Customer and each Traveller until completion of the Services. CHAPTER IXCUSTOMER CONDUCT, HEALTH, AND SAFETY 9.1 General Standard of ConductThe Customer and each Traveller shall behave in a lawful, respectful, and responsible manner throughout the duration of the Services. All Travellers are expected to respect the rights, safety, dignity, culture, customs, property, and wellbeing of fellow participants, Sportsmedia Indonesia personnel, suppliers, host organisations, and members of the public. 9.2 Compliance with Laws and RulesEach Traveller shall comply with:
all applicable laws and regulations;
immigration and customs requirements;
public health measures;
airline and transportation regulations;
accommodation rules;
venue regulations;
sporting rules;
educational institution policies; and
reasonable instructions issued by Sportsmedia Indonesia or its authorised representatives.
9.3 Health and Fitness to TravelThe Customer is responsible for ensuring that every Traveller is medically fit to participate in the relevant programme or travel arrangements. Where a Traveller has a medical condition, disability, allergy, dietary requirement, or other circumstance that may reasonably affect participation, the Customer shall notify Sportsmedia Indonesia before the Booking is confirmed or as soon as reasonably practicable thereafter. Sportsmedia Indonesia may request relevant medical information where necessary to facilitate safe participation. 9.4 MedicationTravellers requiring medication are responsible for carrying an adequate supply throughout the journey together with any prescriptions or supporting medical documentation required by the destination country. Sportsmedia Indonesia shall not be responsible for the availability of medication outside Indonesia or for any restrictions imposed by foreign authorities. 9.5 Alcohol, Drugs, and Prohibited SubstancesNo Traveller shall:
possess or consume illegal drugs;
misuse controlled substances;
consume alcohol where prohibited by law or programme rules;
participate while under the influence of alcohol or drugs where such conduct creates a safety risk; or
engage in any unlawful substance-related activity.
Sportsmedia Indonesia reserves the right to remove any Traveller from the programme where such conduct endangers safety or breaches applicable laws. 9.6 Dangerous BehaviourSportsmedia Indonesia may refuse participation or remove any Traveller whose behaviour:
endangers themselves or others;
threatens the safety or security of the programme;
causes serious disruption;
damages property;
constitutes harassment, bullying, discrimination, violence, intimidation, or abusive behaviour; or
is otherwise considered unacceptable under applicable laws or programme standards.
No refund shall normally be payable where removal results from the Traveller's own misconduct. 9.7 Sporting ConductTravellers participating in sporting activities shall comply with:
competition regulations;
codes of conduct;
anti-doping rules;
safeguarding policies;
eligibility requirements;
technical regulations; and
instructions issued by the relevant governing body or event organiser.
Sportsmedia Indonesia shall not be responsible for sanctions imposed by sporting authorities arising from the Traveller's own conduct. 9.8 Educational ProgrammesParticipants attending educational programmes, schools, universities, academies, exchange programmes, or training institutions shall comply with all applicable institutional policies, codes of conduct, disciplinary rules, attendance requirements, and academic standards. Disciplinary action taken by such institutions shall remain their sole responsibility. 9.9 Safety InstructionsTravellers shall comply promptly with all reasonable health and safety instructions issued by:
Sportsmedia Indonesia;
airlines;
transportation providers;
accommodation providers;
venue operators;
sporting organisations;
educational institutions;
government authorities; or
emergency services.
Failure to comply may result in removal from the programme. 9.10 Personal PropertyEach Traveller remains solely responsible for safeguarding their own money, passports, travel documents, baggage, electronic devices, sporting equipment, valuables, and personal belongings. Sportsmedia Indonesia shall not be liable for loss, theft, or damage except where caused directly by its negligence or as otherwise required by applicable law. 9.11 Sporting EquipmentTravellers bringing sporting equipment shall ensure that such equipment complies with airline regulations, customs requirements, venue rules, and applicable safety standards. Any transportation, storage, repair, insurance, or replacement costs relating to sporting equipment shall remain the responsibility of the Traveller unless otherwise agreed in writing. 9.12 Medical EmergenciesWhere a Traveller requires urgent medical attention, Sportsmedia Indonesia may take reasonable steps to obtain appropriate medical assistance. The Customer acknowledges that all medical treatment, hospitalisation, evacuation, medication, ambulance services, and related expenses remain the responsibility of the Traveller or their insurer unless otherwise required by applicable law. 9.13 Infectious DiseasesTravellers experiencing symptoms of an infectious disease shall promptly inform Sportsmedia Indonesia where such illness may reasonably affect the health or safety of others. Sportsmedia Indonesia may implement reasonable health and safety measures, including isolation, programme modifications, or removal from activities, where necessary to protect participants. 9.14 MinorsWhere a Minor participates in any programme, the Customer, Parent, Legal Guardian, Group Leader, or accompanying institution shall remain responsible for ensuring appropriate supervision in accordance with applicable laws and programme requirements. Nothing in these Terms shall be interpreted as transferring parental or guardianship responsibilities to Sportsmedia Indonesia unless expressly agreed in writing. 9.15 Photography and Media ConductTravellers shall respect the privacy, dignity, image rights, and intellectual property rights of other participants. Photographs, videos, recordings, livestreams, or social media content shall not be created or published where prohibited by law, venue rules, institutional policies, or where such activities infringe the rights of others. 9.16 Environmental ResponsibilityTravellers are encouraged to behave responsibly towards the environment by respecting local conservation rules, wildlife protection measures, cultural heritage sites, and sustainable tourism practices. 9.17 Emergency DecisionsWhere immediate action is reasonably necessary to protect the health, safety, or security of Travellers or others, Sportsmedia Indonesia may make operational decisions without prior consultation where circumstances do not reasonably permit. 9.18 Consequences of MisconductWhere a Traveller breaches this Chapter, Sportsmedia Indonesia may, acting reasonably and in accordance with applicable law:
issue a warning;
refuse participation in certain activities;
remove the Traveller from the programme;
terminate the Traveller's participation;
notify parents, legal guardians, schools, universities, sports federations, sponsors, employers, or relevant authorities where appropriate; and/or
recover from the Customer any reasonable costs, losses, damages, penalties, or liabilities arising directly from such misconduct, to the extent permitted by applicable law.
Such actions shall not prejudice any other rights or remedies available to Sportsmedia Indonesia under these Terms or applicable law.
CHAPTER XTRAVEL INSURANCE AND PERSONAL RISK 10.1 Travel Insurance RecommendationSportsmedia Indonesia strongly recommends that every Traveller obtain comprehensive travel insurance before commencing any international or domestic travel programme. Travel insurance should be appropriate to the nature, destination, duration, and activities included in the Booking.For sports programmes, training camps, competitions, adventure activities, or other activities involving physical participation, the Customer should ensure that the insurance policy specifically covers such activities. 10.2 Minimum Recommended CoverageWhere travel insurance is obtained, Sportsmedia Indonesia recommends that the policy provides appropriate coverage for, where applicable:
medical expenses;
emergency medical treatment;
hospitalisation;
medical evacuation and repatriation;
trip cancellation;
trip interruption;
travel delays;
missed connections;
baggage loss, theft, or damage;
personal liability; and
other risks reasonably associated with the relevant programme.
The Customer is responsible for determining whether the selected insurance policy provides adequate coverage. 10.3 Sports and Adventure ActivitiesTravellers participating in sports, training, competitions, physical activities, adventure activities, or other higher-risk programmes must ensure that their insurance policy expressly covers the relevant activities. Certain insurance policies may exclude professional sports, competitive sports, extreme sports, training activities, or participation in organised competitions. Sportsmedia Indonesia shall not be responsible for determining whether a particular insurance policy provides adequate coverage for a Traveller's individual circumstances. 10.4 Pre-Existing Medical ConditionsTravellers should disclose relevant pre-existing medical conditions to their insurer where required by the applicable insurance policy. Failure to make a required disclosure may affect the validity or availability of insurance coverage. Sportsmedia Indonesia shall not be responsible for an insurer's decision to accept, exclude, limit, or reject coverage relating to any medical condition. 10.5 Insurance ExclusionsThe Customer acknowledges that insurance policies may contain exclusions, limitations, deductibles, excess payments, eligibility requirements, territorial restrictions, and other conditions. The Customer is responsible for reviewing the relevant policy documents before purchasing the insurance. Sportsmedia Indonesia does not guarantee that any particular loss or circumstance will be covered by an insurance provider. 10.6 Insurance ClaimsWhere a loss or incident may be covered by travel insurance, the Customer or Traveller shall be responsible for notifying the insurer and submitting the relevant claim. Sportsmedia Indonesia may, where reasonably practicable, provide reasonable supporting documentation relating to the Booking. However, Sportsmedia Indonesia shall not be responsible for the insurer's assessment, investigation, processing time, or decision regarding any claim. 10.7 Medical and Emergency ExpensesUnless otherwise expressly agreed in writing, the Customer or Traveller shall remain responsible for all medical, hospital, evacuation, repatriation, pharmaceutical, dental, ambulance, or other personal expenses incurred during travel. Where such expenses are covered by insurance, the Customer should seek reimbursement directly from the relevant insurer. 10.8 Personal BelongingsTravellers remain responsible for their passports, money, electronic devices, baggage, sporting equipment, personal effects, and other belongings throughout the programme. Where loss, theft, or damage occurs, the Traveller should report the matter promptly to the relevant authority, supplier, insurer, or other appropriate party. Sportsmedia Indonesia shall not be responsible for such loss or damage except to the extent directly caused by its negligence or otherwise required by applicable law. 10.9 Personal LiabilityTravellers are responsible for damage, injury, loss, or other liability caused by their own acts or omissions. Where appropriate, Customers should ensure that their travel insurance includes personal liability coverage. 10.10 Participation in Physical ActivitiesParticipation in sports, physical training, competitions, excursions, outdoor activities, or other activities involving physical risk is undertaken subject to the applicable safety requirements and the Traveller's own responsibility to comply with reasonable instructions. The Customer acknowledges that certain activities may involve inherent risks that cannot reasonably be eliminated.Nothing in this Clause shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable Indonesian law. 10.11 Emergency AssistanceIn an emergency, Sportsmedia Indonesia may assist the Traveller in contacting emergency services, medical providers, insurers, embassies, consulates, family members, or other relevant parties where reasonably practicable. Any such assistance is provided in good faith and does not make Sportsmedia Indonesia responsible for the actions, decisions, treatment, costs, or delays of third parties. 10.12 Medical Evacuation and RepatriationWhere medical evacuation or repatriation becomes necessary, the Customer acknowledges that such arrangements may involve substantial costs and complex coordination. Where available, the Traveller should rely upon the assistance and coverage provided by their travel insurer. Sportsmedia Indonesia may assist with coordination where reasonably practicable but shall not be responsible for the costs unless expressly agreed otherwise in writing or required by applicable law. 10.13 Failure to Obtain InsuranceWhere the Customer chooses not to obtain travel insurance despite Sportsmedia Indonesia's recommendation, the Customer accepts responsibility for risks and expenses that could reasonably have been covered by an appropriate insurance policy, subject always to applicable law. Failure to obtain insurance shall not create any additional liability for Sportsmedia Indonesia. 10.14 Insurance Requirements for Group ProgrammesSportsmedia Indonesia may require proof of appropriate travel insurance for certain programmes where insurance is considered reasonably necessary due to the nature of the activities, destination, participant profile, contractual requirements of a partner, or applicable regulations. Where proof of insurance is required, the Customer must provide the requested documentation within the timeframe specified by Sportsmedia Indonesia. 10.15 Minors and Vulnerable ParticipantsWhere a Minor or participant requiring additional assistance takes part in a programme, the Customer, Parent, Legal Guardian, Group Leader, or sponsoring institution should ensure that appropriate insurance coverage is obtained. Where reasonably necessary, Sportsmedia Indonesia may request evidence of such coverage before participation. 10.16 Third-Party Insurance ProvidersSportsmedia Indonesia does not act as an insurer unless expressly stated in a separate written agreement. Any insurance policy arranged through or recommended by Sportsmedia Indonesia shall remain subject to the terms, conditions, exclusions, and underwriting decisions of the relevant insurance provider. 10.17 No Guarantee of RecoveryThe existence of insurance coverage does not guarantee that a claim will be accepted or that any particular amount will be recovered. Any dispute concerning coverage, eligibility, exclusions, claim assessment, or payment shall be a matter between the Customer or Traveller and the relevant insurer, except where otherwise required by applicable law. 10.18 Continuing ResponsibilityThe Customer and each Traveller remain responsible for maintaining any required insurance coverage for the entire duration of the Booking and for complying with all conditions imposed by the relevant insurance policy. Where an insurance policy requires notification of a change in itinerary, medical condition, activity, or other relevant circumstance, the Traveller shall be responsible for making such notification. CHAPTER XILIABILITY AND LIMITATION OF LIABILITY 11.1 General ResponsibilitySportsmedia Indonesia shall provide the Services with reasonable care, skill, and diligence and in accordance with the Booking Confirmation, these Terms, and applicable laws of the Republic of Indonesia. Sportsmedia Indonesia shall be responsible for losses directly caused by its proven negligence, wilful misconduct, or material breach of its contractual obligations, subject to the limitations and exclusions permitted by applicable law. 11.2 Third-Party SuppliersMany Services included in a Booking are provided by independent third-party suppliers, including airlines, hotels, transportation operators, sporting organisations, educational institutions, venues, activity providers, insurance companies, and local partners. Sportsmedia Indonesia shall use reasonable care when selecting and coordinating such suppliers but does not control their independent operations, decisions, policies, personnel, or performance. Where a third-party supplier is responsible for a particular service, the Customer may be required to pursue any claim directly against that supplier where appropriate. Nothing in this Clause shall exclude any responsibility that Sportsmedia Indonesia has under applicable law for services that it has contractually undertaken to provide. 11.3 Supplier Changes and FailuresSportsmedia Indonesia shall not be responsible for delays, cancellations, alterations, overbooking, service interruptions, or failures caused by third-party suppliers where such matters are beyond Sportsmedia Indonesia's reasonable control. Where reasonably practicable, Sportsmedia Indonesia shall assist the Customer in communicating with the relevant supplier and seeking an appropriate solution. 11.4 Personal Injury and HealthSportsmedia Indonesia shall not be responsible for injury, illness, medical expenses, or health-related consequences arising from circumstances outside its reasonable control or from the Customer's or Traveller's own acts or omissions. Nothing in these Terms shall exclude or limit liability arising from Sportsmedia Indonesia's negligence, wilful misconduct, or any liability that cannot legally be excluded or limited under applicable law. 11.5 Customer's Own Acts or OmissionsSportsmedia Indonesia shall not be responsible for losses arising directly from inaccurate information, failure to provide required documents, failure to comply with instructions, misconduct, unlawful behaviour, failure to obtain appropriate insurance, or other acts or omissions of the Customer or Traveller. Where permitted by applicable law, the Customer may be responsible for reasonable additional costs or losses directly resulting from such acts or omissions. 11.6 Loss of Personal PropertyExcept where directly caused by the negligence or wilful misconduct of Sportsmedia Indonesia or otherwise required by law, Sportsmedia Indonesia shall not be responsible for loss, theft, destruction, or damage to personal belongings, including money, passports, electronic devices, baggage, sporting equipment, or other personal property. Travellers are responsible for taking reasonable precautions to safeguard their belongings. 11.7 Indirect and Consequential LossTo the maximum extent permitted by applicable law, Sportsmedia Indonesia shall not be liable for indirect, incidental, special, or consequential losses arising from the Booking. Such losses may include, where legally recognised:
loss of profit;
loss of business opportunity;
loss of anticipated savings;
loss of goodwill;
loss of reputation;
loss of sponsorship;
loss of future contracts; or
other economic losses that do not arise directly from the relevant breach or event.
This limitation shall not apply where such liability cannot lawfully be excluded or limited. 11.8 Business and Commercial CustomersWhere the Customer is a company, school, university, sports federation, government institution, sponsor, or other organisation acting in the course of its business or institutional activities, Sportsmedia Indonesia shall, to the extent permitted by applicable law, not be liable for indirect or consequential commercial losses suffered by such organisation. 11.9 Limitation of Financial LiabilityTo the maximum extent permitted by applicable law, Sportsmedia Indonesia's aggregate liability arising directly from a Booking shall not exceed the total amount actually paid to Sportsmedia Indonesia by the affected Customer for the specific Services giving rise to the claim. This limitation shall not apply to liability which cannot lawfully be limited or excluded under applicable Indonesian law. 11.10 Exceptions to Liability LimitationNothing in these Terms shall exclude or limit liability to the extent that such exclusion or limitation is prohibited by applicable law, including liability arising from:a. fraud or fraudulent misrepresentation;b. wilful misconduct;c. liability for death or personal injury where such liability cannot legally be excluded or limited;d. violation of mandatory consumer protection rights; ore. any other liability which Indonesian law does not permit the parties to exclude or limit. 11.11 Customer's Duty to Mitigate LossThe Customer and Traveller shall take reasonable steps to minimise any loss or damage arising from an incident affecting the Booking. Where reasonably practicable, the Customer should promptly notify Sportsmedia Indonesia of any problem and provide an opportunity to assist in resolving the matter. Failure to take reasonable steps to mitigate a loss may be taken into account when determining any claim, to the extent permitted by applicable law. 11.12 Notification of ClaimsAny claim relating to the Services should be notified to Sportsmedia Indonesia in writing as soon as reasonably practicable after the Customer becomes aware of the relevant circumstances. The notification should include sufficient information and supporting documentation to allow Sportsmedia Indonesia to investigate the matter. Failure to notify Sportsmedia Indonesia promptly shall not automatically extinguish a legal claim where the Customer has a mandatory legal right to bring such claim. 11.13 Supplier ClaimsWhere a loss arises primarily from the actions or omissions of a third-party supplier, Sportsmedia Indonesia may assist the Customer in pursuing the relevant supplier. The Customer agrees to provide reasonable cooperation and documentation required for such claim. Any compensation, refund, or remedy available from the supplier shall be taken into account when determining any corresponding claim against Sportsmedia Indonesia, to the extent permitted by applicable law. 11.14 Force MajeureSportsmedia Indonesia shall not be liable for failure or delay in performing its obligations to the extent caused by a Force Majeure event, subject to the provisions of Chapter XIV of these Terms and applicable law. 11.15 No Exclusion of Statutory RightsNothing in these Terms is intended to remove, restrict, or waive any mandatory rights or protections granted to consumers under applicable Indonesian laws and regulations. Where a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement shall prevail to the extent of the conflict. 11.16 No Double RecoveryThe Customer shall not be entitled to recover the same loss more than once from Sportsmedia Indonesia, an insurer, a third-party supplier, or another responsible party. Any amounts already recovered in respect of the same loss may be taken into account when determining the amount of any further recovery, to the extent permitted by applicable law. 11.17 Separate LiabilityWhere more than one person or organisation contributes to a loss, Sportsmedia Indonesia shall only be responsible for the portion of the loss properly attributable to its acts or omissions, to the extent permitted by applicable law. 11.18 Survival of Liability ProvisionsThe provisions of this Chapter shall continue to apply after completion, cancellation, or termination of a Booking to the extent necessary to resolve any claim arising from the Services. 11.19 Application of Indonesian LawThe interpretation and enforcement of the liability provisions contained in these Terms shall be subject to the laws of the Republic of Indonesia, subject to the governing law and dispute resolution provisions set out elsewhere in these Terms. CHAPTER XIICOMPLAINTS, CLAIMS, AND PROBLEM RESOLUTION 12.1 Commitment to Handling ComplaintsSportsmedia Indonesia is committed to handling all Customer questions, complaints, and claims fairly, professionally, transparently, and in good faith. Where a Customer experiences a problem in connection with the Services, the Customer is encouraged to first give Sportsmedia Indonesia a reasonable opportunity to understand and resolve the matter. 12.2 Complaints During TravelWhere a problem occurs during travel or while a programme is in progress, the Customer or Traveller should, where reasonably practicable, promptly report the matter to:
a Sportsmedia Indonesia representative;
the Group Leader;
the programme coordinator;
the relevant service provider; or
the emergency contact provided before departure.
Prompt notification enables Sportsmedia Indonesia to take reasonable steps to minimise the impact of the problem and seek a solution as quickly as reasonably possible. 12.3 Complaints to Service ProvidersWhere a problem relates directly to a service provided by a third party, such as a hotel, airline, transportation provider, venue, educational institution, or activity provider, the Customer may be required to raise the complaint directly with the relevant service provider. Sportsmedia Indonesia will, where reasonably practicable, assist in coordinating communication between the Customer and the relevant service provider. 12.4 Complaints After the ProgrammeWhere a problem cannot be resolved during the travel or programme, the Customer may submit a written complaint to Sportsmedia Indonesia after completion of the programme. The complaint should clearly state:a. the identity of the Customer;b. the Booking number or reference, where available;c. the date and location of the incident;d. the Services to which the complaint relates;e. a description of the problem;f. any steps already taken to resolve the matter; andg. the resolution requested by the Customer. 12.5 Supporting DocumentationSportsmedia Indonesia may request information or supporting documentation reasonably required to investigate a complaint or claim. Such documentation may include:
Booking Confirmation;
tickets;
invoices;
payment records;
photographs or videos;
correspondence with service providers;
incident reports;
medical documentation; or
other relevant documents.
The Customer shall provide accurate and complete information. 12.6 Time for Submitting ComplaintsCustomers are encouraged to submit complaints as soon as reasonably practicable after becoming aware of the relevant problem. For administrative and investigation purposes, Sportsmedia Indonesia may request that complaints be submitted within a reasonable period following the event giving rise to the complaint. However, any such timeframe is not intended to remove or reduce any legal rights of the Customer that cannot lawfully be excluded under applicable law. 12.7 Investigation of ComplaintsUpon receiving a sufficiently complete complaint, Sportsmedia Indonesia will conduct a reasonable investigation into the matter. As part of the investigation, Sportsmedia Indonesia may request additional information from the Customer, Traveller, internal personnel, service providers, local partners, or other relevant parties. 12.8 Response TimeSportsmedia Indonesia will endeavour to provide an initial response within a reasonable period after receiving a complaint. Where a complaint requires further investigation, particularly where third parties or events occurring outside Indonesia are involved, resolution may take longer. Sportsmedia Indonesia may provide updates regarding the progress of the complaint where considered appropriate. 12.9 Reasonable ResolutionWhere Sportsmedia Indonesia determines that a complaint has resulted from a failure in Services for which it is responsible, Sportsmedia Indonesia will consider an appropriate and reasonable resolution having regard to the circumstances and applicable law. Depending on the circumstances, a resolution may include:
correction of the service;
alternative arrangements;
partial refund;
reimbursement of certain costs;
travel credit;
reasonable compensation; or
another resolution agreed between the parties.
Not every form of resolution will be available for every type of complaint. 12.10 Resolution by Service ProvidersWhere a matter is primarily the responsibility of a third-party service provider, Sportsmedia Indonesia may direct or assist the Customer in seeking a resolution from that provider. Sportsmedia Indonesia does not guarantee that the third party will accept the claim or provide any particular compensation. 12.11 Complaints Involving EmergenciesComplaints involving accidents, serious injury, loss of travel documents, criminal activity, medical emergencies, or threats to personal safety must be reported immediately through the available emergency communication channels. The complaint-handling process must not delay any action reasonably necessary to protect a person's health or safety. 12.12 Claims for Loss or DamageWhere a Customer makes a claim for loss or damage, the Customer shall provide sufficient information to enable Sportsmedia Indonesia to assess:a. the event giving rise to the loss;b. the connection between the event and the Services;c. the amount of loss being claimed; andd. relevant supporting documentation. Sportsmedia Indonesia may request evidence reasonably required before considering a claim. 12.13 No Automatic Admission of LiabilityThe receipt, review, or investigation of a complaint or claim by Sportsmedia Indonesia does not constitute an admission of liability for the matter or loss claimed. Each claim will be assessed based on the relevant facts, supporting documentation, Booking arrangements, these Terms, and applicable law. 12.14 Good Faith and CooperationThe Customer and Sportsmedia Indonesia shall seek to resolve complaints fairly and in good faith. Both parties are expected to provide relevant information, avoid misleading statements, and provide the other party with a reasonable opportunity to respond to the matter. 12.15 Resolution Before Formal DisputeBefore commencing formal dispute resolution proceedings, the parties are encouraged to first attempt to resolve the matter through direct communication and good-faith negotiation. Nothing in this Clause prevents either party from taking legal action where necessary or where required by applicable law. 12.16 MediationWhere a complaint or dispute cannot be resolved through direct communication, the parties may agree to use mediation or another appropriate alternative dispute resolution mechanism before commencing formal legal proceedings. Where mediation is used, the parties may agree on the mediator, location, language, and applicable mediation procedure. 12.17 Consumer Rights Remain UnaffectedNothing in this Chapter is intended to remove, restrict, or reduce any rights available to the Customer as a consumer under applicable Indonesian laws and regulations. The Customer retains the right to use any available complaint mechanism, dispute resolution procedure, or legal remedy provided under applicable law. 12.18 ConfidentialitySportsmedia Indonesia will handle information received during the complaint or claims process carefully and in accordance with applicable personal data protection requirements and confidentiality obligations. Information will only be used or disclosed to the extent reasonably necessary to handle the complaint, comply with legal obligations, protect the legitimate interests of the parties, or as otherwise permitted by applicable law. 12.19 Decision on a ComplaintOnce the investigation has been completed, Sportsmedia Indonesia will provide a response regarding the outcome of the complaint to the extent reasonably practicable and subject to any legal or confidentiality obligations relating to other parties. Where a complaint is rejected, Sportsmedia Indonesia may provide reasonable grounds for the decision where appropriate. 12.20 Right to Take Further ActionWhere the Customer is dissatisfied with the outcome of the complaint process, the Customer may use any dispute resolution mechanism or legal remedy available under applicable law, subject to the governing law and dispute resolution provisions contained elsewhere in these Terms. CHAPTER XIIIPERSONAL DATA PROTECTION AND PRIVACY 13.1 Commitment to Personal Data ProtectionSportsmedia Indonesia is committed to protecting the personal data and privacy of Customers, Travellers, Parents or Legal Guardians, Group Leaders, accompanying staff, and other individuals whose personal data is provided to Sportsmedia Indonesia in connection with the Services. Sportsmedia Indonesia will process personal data in accordance with applicable laws and regulations of the Republic of Indonesia, including Law No. 27 of 2022 concerning Personal Data Protection ("PDP Law"), and other applicable data protection requirements. 13.2 Personal DataFor the purposes of these Terms, personal data means information relating to an identified or identifiable individual. Depending on the nature of the Booking, personal data may include:
full name;
date and place of birth;
nationality;
residential or postal address;
email address;
telephone number;
passport and travel document details;
visa and immigration information;
emergency contact details;
dietary requirements;
health or medical information;
information relating to accessibility requirements;
photographs and audiovisual recordings;
educational or sporting information;
payment and transaction information; and
other information reasonably required to provide the Services.
13.3 Processing of Personal DataSportsmedia Indonesia may collect, record, organise, store, use, disclose, transfer, modify, retrieve, or delete personal data where necessary for purposes connected with the Services and in accordance with applicable law. Personal data may be processed for purposes including:a. responding to enquiries;b. preparing proposals and quotations;c. confirming and administering Bookings;d. arranging travel, accommodation, transportation, activities, and other Services;e. complying with immigration, visa, regulatory, safety, and legal requirements;f. communicating with Customers and Travellers;g. managing emergencies;h. coordinating with suppliers and local partners;i. processing payments;j. managing complaints and claims;k. improving Services; andl. conducting marketing activities where permitted by applicable law and where the required consent or other lawful basis has been obtained. 13.4 Legal Basis for ProcessingSportsmedia Indonesia will process personal data based on one or more lawful grounds available under applicable Indonesian law. Depending on the circumstances, processing may be necessary for:
taking steps requested by the Customer before entering into an agreement;
performing or administering a Booking or contractual relationship;
complying with legal or regulatory obligations;
protecting the vital interests of an individual in an emergency;
fulfilling other lawful purposes recognised under applicable law; or
obtaining consent where consent is required.
13.5 Sensitive Personal DataCertain information may receive enhanced protection under applicable Indonesian data protection laws. Depending on the circumstances, this may include information relating to:
health or medical conditions;
biometric information;
genetic information;
financial information;
information concerning children; and
other categories of personal data receiving specific protection under applicable law.
Sportsmedia Indonesia will only process such information where there is an appropriate lawful basis and where reasonably necessary for the relevant purpose. 13.6 Health and Medical InformationWhere health or medical information is required to safely provide the Services, the Customer or Traveller shall provide accurate and relevant information. Such information may be shared, where legally permitted and reasonably necessary, with appropriate parties such as:
medical providers;
emergency services;
insurers;
accommodation providers;
activity operators;
educational institutions;
sporting organisations; or
other persons responsible for the safety and wellbeing of the Traveller.
Sportsmedia Indonesia will seek to limit such disclosure to information reasonably necessary for the relevant purpose. 13.7 Personal Data of MinorsWhere a Booking involves a Minor, Sportsmedia Indonesia may process the Minor's personal data where permitted or required by applicable law and where necessary to provide the Services or protect the Minor's safety and wellbeing. Where required, Sportsmedia Indonesia may request appropriate authorisation or consent from a Parent, Legal Guardian, authorised institution, or other person legally authorised to act on behalf of the Minor. 13.8 Group BookingsWhere a Group Leader, school, university, sports organisation, sponsor, employer, parent, guardian, or other organisation provides personal data relating to other Travellers, that party shall ensure that it is authorised to provide such information to Sportsmedia Indonesia and that any required notices, permissions, or consents have been appropriately addressed. Sportsmedia Indonesia may reasonably request confirmation of such authority where necessary. 13.9 Third-Party DataSportsmedia Indonesia may receive personal data from third parties, including:
schools;
universities;
sports federations;
clubs;
sponsors;
employers;
parents or guardians;
Group Leaders;
event organisers;
travel partners; or
other authorised organisations.
Such information will be processed in accordance with applicable law and for legitimate purposes connected with the Services. 13.10 Disclosure to Service ProvidersSportsmedia Indonesia may disclose relevant personal data to third parties where reasonably necessary to provide the Services. Such third parties may include:
airlines;
hotels;
transportation providers;
tour operators;
activity providers;
educational institutions;
sporting organisations;
venues;
insurance providers;
payment processors;
technology and IT service providers;
local partners; and
professional advisers.
Sportsmedia Indonesia will seek to limit disclosure to information reasonably required for the relevant purpose. 13.11 International Data TransfersBecause Sportsmedia Indonesia may arrange international travel and programmes, personal data may need to be transferred to or accessed from countries outside Indonesia. Such transfers may occur, for example, when arranging:
international flights;
overseas accommodation;
foreign educational programmes;
sporting competitions;
training camps;
international insurance;
visa or immigration arrangements; or
services provided by overseas partners.
Sportsmedia Indonesia will undertake such transfers in accordance with the requirements of applicable Indonesian data protection law. 13.12 Data SecuritySportsmedia Indonesia will implement appropriate technical and organisational measures designed to protect personal data against:
unauthorised access;
unauthorised disclosure;
alteration;
misuse;
loss;
destruction; or
other unlawful processing.
However, no method of electronic transmission or storage can be guaranteed to be completely secure. 13.13 Data RetentionSportsmedia Indonesia will retain personal data only for as long as reasonably necessary for the purposes for which it was collected, to fulfil contractual and legal obligations, resolve disputes, maintain appropriate business records, or otherwise as permitted or required by applicable law. Retention periods may vary depending on the type of information and the purpose for which it is processed. 13.14 Personal Data RightsSubject to applicable law and relevant conditions or limitations, individuals may have rights relating to their personal data, including rights to:
obtain information regarding the processing of their personal data;
access their personal data;
correct or update inaccurate personal data;
request deletion or destruction of personal data where legally applicable;
withdraw consent where processing is based on consent;
object to certain processing where applicable;
request restriction or suspension of processing where legally available;
obtain or receive personal data in a legally recognised format where applicable; and
exercise other rights provided under applicable Indonesian law.
13.15 Exercising Data Protection RightsRequests concerning personal data may be submitted to Sportsmedia Indonesia using the contact details specified in the Privacy Policy. Sportsmedia Indonesia may request reasonable information necessary to verify the identity of the person making the request and to protect personal data from unauthorised disclosure. 13.16 ConsentWhere Sportsmedia Indonesia relies on consent as the lawful basis for processing personal data, the relevant individual may withdraw consent in accordance with applicable law. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal. Where personal data is necessary to perform a Booking or comply with a legal obligation, withdrawing consent may not prevent Sportsmedia Indonesia from continuing to process the information on another lawful basis. 13.17 Marketing CommunicationsSportsmedia Indonesia may send marketing communications where permitted by applicable law and where the necessary consent or other lawful basis has been obtained. Customers may opt out of marketing communications at any time by using the unsubscribe mechanism provided in the relevant communication or by contacting Sportsmedia Indonesia. 13.18 Photography, Video, and MediaDuring tours, sporting events, educational programmes, training camps, and other activities, photographs, videos, or other audiovisual materials may be created by Sportsmedia Indonesia, its partners, event organisers, venues, or other authorised parties. The collection and use of such materials involving identifiable individuals shall be handled in accordance with applicable law and the relevant Privacy Policy, consent requirements, event rules, or other applicable arrangements.Where specific consent is required for a particular use, Sportsmedia Indonesia will seek such consent where appropriate. 13.19 Data Breach and Security IncidentsWhere Sportsmedia Indonesia becomes aware of a personal data breach or other security incident requiring action under applicable law, Sportsmedia Indonesia will take reasonable steps to investigate, contain, mitigate, and respond to the incident and make any notifications required by law. 13.20 ConfidentialitySportsmedia Indonesia will treat personal data as confidential and will only disclose it to persons or organisations that have a legitimate need to receive it, where legally permitted or required. This obligation does not prevent disclosure required by law, court order, government authority, emergency circumstances, or other lawful requirements. 13.21 Relationship with Privacy PolicyThis Chapter should be read together with the Sportsmedia Indonesia Privacy Policy, which provides further information about how personal data is collected, used, stored, disclosed, transferred, and protected. Where there is a difference between this Chapter and the Privacy Policy, the provision that provides the greater level of protection to the individual shall apply to the extent permitted by applicable law, unless the difference is required by a mandatory legal requirement or relates specifically to the contractual Services. 13.22 Compliance with Indonesian Data Protection LawSportsmedia Indonesia intends to process personal data in accordance with applicable Indonesian data protection laws and regulations. Nothing in these Terms is intended to remove or restrict any mandatory rights of data subjects under applicable law. CHAPTER XIVFORCE MAJEURE 14.1 Definition of Force MajeureFor the purposes of these Terms, a Force Majeure Event means an event, circumstance, or condition beyond the reasonable control of Sportsmedia Indonesia or the relevant party, which prevents, materially affects, or substantially delays the performance of an obligation under a Booking. A Force Majeure Event may include, but is not limited to:a. natural disasters, including earthquakes, tsunamis, volcanic eruptions, floods, landslides, storms, extreme weather, or other natural events;b. epidemics, pandemics, outbreaks of infectious diseases, public health emergencies, or related government measures;c. war, armed conflict, terrorism, civil unrest, riots, rebellion, or political instability;d. government actions, regulations, restrictions, prohibitions, travel bans, border closures, immigration restrictions, quarantine requirements, or emergency measures;e. airport closures, flight restrictions, airspace closures, port closures, or major transportation disruptions;f. strikes, industrial disputes, labour shortages, or other significant disruptions affecting essential services;g. major failures of public infrastructure, telecommunications, electricity, water, or essential systems;h. cyberattacks or significant technology failures that could not reasonably have been prevented or mitigated;i. serious security threats or circumstances creating an unreasonable risk to the safety of Travellers;j. cancellation, suspension, or substantial alteration of an event, competition, educational programme, venue, or activity by the relevant organiser or authority; ork. any other event beyond the reasonable control of the affected party which could not reasonably have been anticipated, prevented, or overcome. 14.2 Effect of Force MajeureWhere a Force Majeure Event affects the performance of a Booking, Sportsmedia Indonesia shall not be considered in breach of its obligations to the extent that its performance is prevented, materially affected, or delayed by the Force Majeure Event. Sportsmedia Indonesia shall take reasonable steps to minimise the impact of the event and, where reasonably practicable, seek alternative arrangements. 14.3 No Guarantee of ContinuationSportsmedia Indonesia does not guarantee that a Booking, programme, tour, event, training camp, educational activity, or other Service can continue as originally planned following a Force Majeure Event. The safety of Travellers and compliance with applicable laws and official requirements shall take priority over the original itinerary or programme arrangements. 14.4 Changes to Itinerary or ProgrammeWhere reasonably necessary due to a Force Majeure Event, Sportsmedia Indonesia may modify, postpone, suspend, relocate, shorten, extend, or otherwise alter an itinerary or programme. Such changes may include changes to:
travel dates;
flight arrangements;
accommodation;
transportation;
venues;
activities;
training locations;
educational institutions;
sporting events;
schedules; or
other programme components.
Sportsmedia Indonesia will endeavour to provide reasonable notice of significant changes where circumstances permit. 14.5 Alternative ArrangementsWhere a Force Majeure Event affects a planned Service, Sportsmedia Indonesia may seek reasonable alternative arrangements. Alternative arrangements may involve a different:
airline;
hotel;
transportation provider;
venue;
activity;
educational institution;
sporting facility;
programme location; or
travel schedule.
Any additional cost, refund, credit, or adjustment resulting from an alternative arrangement shall be considered in accordance with the Booking terms, supplier policies, and applicable law. 14.6 Supplier-Related Force MajeureA Force Majeure Event may affect a third-party supplier rather than Sportsmedia Indonesia directly. Where a supplier is unable to provide a contracted Service due to a Force Majeure Event, Sportsmedia Indonesia will use reasonable efforts to assist the Customer and seek an appropriate alternative where practicable. Sportsmedia Indonesia shall not be responsible for losses caused solely by the supplier's Force Majeure Event, except to the extent otherwise required by applicable law. 14.7 Government RestrictionsWhere a government, immigration authority, airport authority, health authority, sporting authority, educational institution, or other competent authority introduces restrictions that affect a Booking, Sportsmedia Indonesia may take reasonable measures necessary to comply with those requirements. Such measures may include postponement, cancellation, rerouting, relocation, additional documentation, health requirements, or other modifications to the programme. 14.8 Travel Advisories and Safety ConcernsSportsmedia Indonesia may modify or suspend Services where reliable information indicates that continuing the planned programme would create a significant or unreasonable risk to the safety or wellbeing of Travellers. Relevant information may include official travel advisories, government warnings, security assessments, public health information, weather conditions, or information from competent local authorities. 14.9 Customer's Obligations During Force MajeureCustomers and Travellers must reasonably cooperate with Sportsmedia Indonesia and relevant authorities during a Force Majeure Event. This may include complying with:
revised travel arrangements;
safety instructions;
evacuation procedures;
government requirements;
health and medical requirements;
immigration requirements;
transportation changes; and
reasonable instructions issued by Sportsmedia Indonesia or its authorised representatives.
14.10 Additional CostsA Force Majeure Event may result in additional costs, including costs associated with:
alternative flights;
additional accommodation;
transportation changes;
meals;
emergency arrangements;
visa or immigration requirements;
medical assistance;
programme relocation; or
extended stays.
Responsibility for such costs shall depend on the circumstances, applicable Booking terms, supplier policies, insurance coverage, and applicable law. Where possible, Sportsmedia Indonesia will inform the Customer of significant additional costs before they are incurred. 14.11 Refunds and CreditsWhere a Service is cancelled, materially changed, or cannot be provided due to a Force Majeure Event, any refund, credit, or other financial adjustment will be determined having regard to:a. amounts already paid to third-party suppliers;b. amounts recoverable from those suppliers;c. applicable cancellation and refund policies;d. insurance coverage;e. alternative arrangements offered;f. the Services already provided; andg. applicable Indonesian law. Sportsmedia Indonesia will not retain amounts that it is legally required to return to the Customer. 14.12 InsuranceCustomers are strongly encouraged to obtain appropriate travel insurance that covers, where available, cancellation, interruption, medical expenses, emergency evacuation, travel delays, lost baggage, and other risks relevant to the Booking.The existence of travel insurance does not automatically transfer Sportsmedia Indonesia's legal responsibilities to the Customer or insurer. 14.13 No Liability for Unavoidable ConsequencesTo the maximum extent permitted by applicable law, Sportsmedia Indonesia shall not be liable for losses that arise solely and directly from the unavoidable consequences of a Force Majeure Event. This includes circumstances where the relevant loss could not reasonably have been prevented or avoided despite reasonable efforts. 14.14 Duty to MitigateSportsmedia Indonesia will take reasonable steps to mitigate the impact of a Force Majeure Event on the Customer and Travellers. Customers and Travellers are likewise expected to take reasonable steps to minimise their own losses and comply with reasonable instructions provided during the affected period. 14.15 CommunicationWhere reasonably practicable, Sportsmedia Indonesia will communicate material information concerning a Force Majeure Event through available communication channels, including email, telephone, messaging services, website notices, or other appropriate means. Customers are responsible for ensuring that Sportsmedia Indonesia has accurate and current contact information. 14.16 Termination or CancellationWhere a Force Majeure Event continues for a period that makes it impracticable or unreasonable to continue a Booking or programme, Sportsmedia Indonesia or the Customer may seek to cancel or terminate the affected Services, subject to the applicable Booking terms, supplier conditions, and applicable law. Any financial consequences of such cancellation or termination shall be determined in accordance with the relevant contractual arrangements and applicable law. 14.17 Force Majeure Affecting the CustomerA Force Majeure Event may also affect the Customer or Traveller personally. Examples may include serious illness, family emergencies, travel restrictions affecting the Traveller, or other circumstances beyond the Traveller's reasonable control. The consequences of such circumstances shall be considered in accordance with the applicable cancellation, amendment, refund, insurance, and Booking provisions. 14.18 Continuing ObligationsA Force Majeure Event shall not automatically terminate obligations that can reasonably continue to be performed. The parties shall continue to perform unaffected obligations to the extent reasonably possible. 14.19 No Automatic Right to CompensationA Force Majeure Event does not automatically create a right to compensation from Sportsmedia Indonesia. Any refund, reimbursement, credit, compensation, or other remedy shall depend on the circumstances, contractual arrangements, supplier recovery, insurance coverage, and applicable law. 14.20 Compliance with Applicable LawNothing in this Chapter shall exclude or limit any mandatory rights or obligations imposed by Indonesian law. Where a mandatory legal requirement applies to a Force Majeure Event, that legal requirement shall prevail to the extent of any inconsistency with these Terms. 14.21 Good Faith and Reasonable CooperationSportsmedia Indonesia and the Customer shall act in good faith and cooperate reasonably when responding to a Force Majeure Event. Both parties shall seek practical solutions that appropriately consider the safety of Travellers, contractual obligations, financial consequences, and applicable legal requirements. 14.22 Survival of Relevant ObligationsAny provisions of these Terms that are intended by their nature to continue after cancellation, termination, or completion of the affected Services shall remain effective despite the occurrence of a Force Majeure Event. CHAPTER XVINSURANCE, HEALTH, MEDICAL AND PERSONAL RISKS 15.1 Importance of Travel InsuranceSportsmedia Indonesia strongly recommends that every Customer and Traveller obtain adequate travel insurance before travelling or participating in a programme. The recommended coverage may include, where available:
cancellation or amendment of travel;
travel interruption;
medical expenses;
hospitalisation;
medical evacuation;
repatriation;
accidents;
lost or delayed baggage;
loss of travel documents;
flight delays;
additional expenses arising from emergencies; and
other risks relevant to the nature of the travel or programme.
15.2 Customer Responsibility for InsuranceThe Customer is responsible for ensuring that the Customer and all Travellers in their group have appropriate insurance coverage having regard to the nature, purpose, destination, duration, and activities involved in the travel. Sportsmedia Indonesia is not responsible for providing insurance for Customers or Travellers unless expressly stated otherwise in the Booking Confirmation or in a separate written agreement. 15.3 High-Risk ActivitiesCertain Sportsmedia Indonesia programmes may involve sports, training, competitions, outdoor activities, or other activities that carry a higher level of risk than ordinary travel. These may include:
BMX;
competitive sports;
boxing;
water sports;
outdoor activities;
training camps;
adventure activities;
activities involving speed or height; and
other activities carrying a risk of injury.
Customers must ensure that their insurance policy provides appropriate coverage for the activities in which they will participate. 15.4 Insurance ExclusionsCustomers acknowledge that insurance policies may contain exclusions, coverage limits, deductibles, health requirements, or other specific conditions. Sportsmedia Indonesia shall not be responsible for an insurer's rejection of a claim arising from:
an activity that is not covered;
an excluded condition;
inaccurate or incomplete information;
late submission of a claim;
breach of the insurance policy; or
any other matter arising from the contractual relationship between the Customer and the insurer.
15.5 Pre-Existing Medical ConditionsCustomers and Travellers should take into account any pre-existing medical conditions when selecting travel insurance. Where a medical condition may affect a Traveller's ability to participate in travel or activities, the Customer is responsible for ensuring that the relevant information has been disclosed to the appropriate party and that any necessary insurance coverage has been obtained. 15.6 Health InformationCustomers must provide relevant, accurate, and non-misleading health information where such information is reasonably required for the safety of a Traveller or the provision of the Services. Such information may include:
medical conditions;
allergies;
medication requirements;
dietary requirements;
physical limitations;
accessibility requirements;
conditions requiring special attention; or
other relevant health information.
15.7 Failure to Disclose Relevant Health InformationFailure to provide relevant health information may affect the ability of Sportsmedia Indonesia or a service provider to take appropriate safety measures. Where information provided is incomplete or inaccurate, Sportsmedia Indonesia cannot guarantee that appropriate arrangements can be made. Nothing in this Clause limits any obligation of Sportsmedia Indonesia that cannot lawfully be excluded under applicable law. 15.8 Fitness to ParticipateThe Customer is responsible for ensuring that each Traveller is medically and physically fit to participate in the booked travel or activities. For certain activities, Sportsmedia Indonesia or a service provider may require health information, a declaration, medical certificate, or other documentation reasonably necessary to establish a participant's fitness to take part. 15.9 Medical Assessment or ClearanceIn certain circumstances, a service provider, activity operator, educational institution, sports organisation, or event organiser may impose specific health requirements or medical clearance procedures. Customers and Travellers must comply with such requirements where reasonably required by the relevant authority or necessary for the safe participation in the activity. 15.10 MedicationTravellers are responsible for bringing any personal medication required during their journey and for ensuring that such medication is carried and used in accordance with the laws of the country of departure, transit countries, and destination country. Sportsmedia Indonesia shall not be responsible for the loss, damage, delay, or unavailability of personal medication, except to the extent otherwise required by applicable law. 15.11 Medical EmergenciesIf a medical emergency occurs during a programme or journey, Sportsmedia Indonesia and/or its representatives may take reasonable steps necessary to protect the safety and wellbeing of the Traveller. Such steps may include:
contacting emergency services;
contacting a hospital or medical facility;
arranging medical transportation;
contacting family members or emergency contacts;
contacting the insurer; or
taking other reasonable action appropriate to the circumstances.
15.12 Authorisation in an EmergencyWhere a Traveller or Customer is unable to provide instructions or consent directly during an emergency, Sportsmedia Indonesia may provide relevant information to medical professionals, emergency services, insurers, or other authorised parties to the extent reasonably necessary to protect the Traveller's safety and vital interests. 15.13 Medical ExpensesUnless expressly agreed otherwise in writing, medical expenses, treatment, hospitalisation, medication, medical evacuation, repatriation, or other healthcare costs are the responsibility of the Customer or Traveller and/or their insurer. Sportsmedia Indonesia may assist with reasonable administrative coordination where practicable, but such assistance does not mean that Sportsmedia Indonesia assumes responsibility for payment. 15.14 Sports Activities and Risk of InjuryTravellers participating in sports or physical activities acknowledge that such activities may involve a risk of injury, including minor injury, serious injury, or, in certain circumstances, more significant risks. Customers and Travellers must comply with:
safety rules;
coaches' instructions;
organisers' instructions;
safety equipment requirements;
venue requirements; and
other rules applicable to the activity.
15.15 Safety EquipmentWhere an activity requires specific safety equipment, the Traveller must use such equipment in accordance with the instructions of the organiser or activity operator. Sportsmedia Indonesia may refuse or discontinue a Traveller's participation in an activity where the Traveller does not comply with reasonable safety requirements. 15.16 Decision to Restrict or Stop ParticipationSportsmedia Indonesia, coaches, instructors, activity operators, or event organisers may restrict or discontinue a Traveller's participation in an activity where there are reasonable safety grounds for doing so. Such a decision may be based on:
the Traveller's health condition;
weather conditions;
venue conditions;
the participant's ability level;
equipment conditions;
instructions from a competent authority; or
other relevant safety considerations.
15.17 No Guarantee of Sporting or Programme ResultsSportsmedia Indonesia does not guarantee any particular result from participation in sports activities, training camps, educational programmes, or other development programmes. Results may be affected by various factors, including individual ability, physical condition, experience, training level, environmental conditions, and decisions made by coaches or programme organisers. 15.18 Mental Health and Participant WellbeingWhere a programme involves group travel, education, sports, or intensive activities, Sportsmedia Indonesia will take reasonable steps to support the general wellbeing of participants. Customers and Travellers are encouraged to disclose any specific needs that should reasonably be known in order to support the safety and wellbeing of the participant. 15.19 Children and Underage ParticipantsFor Travellers under the age of 18, the Parent or Legal Guardian is responsible for ensuring that:a. the participant is medically fit to take part in the programme;b. relevant medical information has been provided;c. necessary medication is available;d. appropriate insurance coverage has been obtained; ande. all applicable health, safety, and travel requirements have been satisfied. 15.20 Parent or Legal Guardian ConsentFor programmes involving Children, Sportsmedia Indonesia may require written consent, health forms, emergency contact information, travel authorisations, or other documentation from the Parent or Legal Guardian. Such documentation may be required before the participant is permitted to participate in the programme. 15.21 Information Provided to Service ProvidersFor safety, health, insurance, or Service-related purposes, Sportsmedia Indonesia may provide relevant health information or other relevant information to service providers that reasonably require such information, to the extent permitted by law and reasonably necessary. Any such disclosure will be handled in accordance with the personal data protection provisions set out in Chapter XIII and the Sportsmedia Indonesia Privacy Policy. 15.22 Responsibility and LimitationSportsmedia Indonesia will take reasonable steps to support the safety and wellbeing of Travellers while the Services are being provided. However, Sportsmedia Indonesia cannot guarantee that accidents, illness, injury, or other medical circumstances will not occur. Nothing in this Chapter is intended to exclude or limit any liability of Sportsmedia Indonesia that cannot lawfully be excluded or limited under Indonesian law. 15.23 Insurance as Additional ProtectionTravel insurance is intended to provide additional protection and does not replace any legal obligations of Sportsmedia Indonesia. Customers retain any rights available to them under applicable law against Sportsmedia Indonesia where a failure by Sportsmedia Indonesia to perform its legal or contractual obligations gives rise to liability. 15.24 Duty to CooperateCustomers and Travellers must provide reasonable cooperation in relation to:
health assessments;
safety procedures;
emergencies;
evacuation;
communication with medical professionals;
insurance claims; and
other actions reasonably necessary to protect the safety and wellbeing of Travellers.
15.25 Relationship with the Privacy PolicyThe collection, use, storage, disclosure, and protection of health information and other Personal Data will be carried out in accordance with Chapter XIII — Personal Data Protection and Privacy and the Sportsmedia Indonesia Privacy Policy. CHAPTER XVICANCELLATION, AMENDMENT, REFUND AND CREDIT 16.1 General PrincipleBookings for travel, accommodation, transportation, sporting activities, educational programmes, events, and other Services may involve commitments and payments to third-party suppliers. Accordingly, the consequences of a cancellation or amendment may depend on the terms imposed by the relevant supplier, the timing of the cancellation or amendment, the Services involved, and the applicable law. Sportsmedia Indonesia will apply cancellation, amendment, refund, and credit arrangements fairly and transparently, subject to these Terms, the applicable Booking Confirmation, supplier conditions, and Indonesian law. 16.2 Customer CancellationA Customer may request cancellation of a Booking by providing written notice to Sportsmedia Indonesia. The effective cancellation date shall generally be the date on which Sportsmedia Indonesia receives the cancellation request, unless otherwise agreed in writing. Cancellation charges, if applicable, will be determined based on the Booking terms, the timing of cancellation, amounts already committed to suppliers, and applicable law. 16.3 Cancellation Before ConfirmationWhere a Customer cancels an enquiry or proposed arrangement before Sportsmedia Indonesia has confirmed the Booking and before any non-refundable commitment has been made to a supplier, no cancellation charge will generally apply. However, any third-party costs already incurred or expressly authorised by the Customer may remain payable. 16.4 Cancellation After Booking ConfirmationOnce a Booking has been confirmed, cancellation charges may apply. The applicable cancellation terms may be specified in:
the Booking Confirmation;
the relevant quotation;
a separate written agreement;
supplier terms and conditions; or
these Terms.
Where specific cancellation terms have been agreed for a particular Booking, those terms will apply to the extent permitted by applicable law. 16.5 Non-Refundable ComponentsCertain components of a Booking may be non-refundable because the relevant supplier does not permit cancellation or refund. These may include:
airline tickets;
accommodation deposits;
event tickets;
competition registration;
venue fees;
transportation arrangements;
visa or administrative fees;
activity bookings;
educational programme fees; or
other supplier charges expressly identified as non-refundable.
Sportsmedia Indonesia will communicate material non-refundable components to the Customer where reasonably practicable before the Customer commits to the Booking. 16.6 Deposit and Advance PaymentsA deposit or advance payment may be required to secure a Booking. The amount and payment schedule will be stated in the relevant quotation, Booking Confirmation, invoice, or agreement. Unless otherwise stated, payment of a deposit does not necessarily mean that the deposit is automatically forfeited in every circumstance. Its treatment upon cancellation will depend on the applicable Booking terms, supplier commitments, and applicable law. 16.7 Supplier Cancellation ChargesWhere a supplier imposes cancellation charges, Sportsmedia Indonesia may pass on those charges to the Customer to the extent permitted by the applicable Booking arrangements and law. Sportsmedia Indonesia will not intentionally impose supplier cancellation charges that it has not actually incurred or is not contractually required to pay. 16.8 Cancellation Charges Must Be ReasonableCancellation charges should reasonably reflect costs, commitments, losses, or expenses arising from the cancellation and the circumstances of the Booking. Nothing in these Terms is intended to create an unreasonable penalty or to deprive a Customer of rights that cannot legally be excluded. 16.9 Amendment of a BookingA Customer may request an amendment to a Booking, including changes to:
travel dates;
number of Travellers;
accommodation;
transportation;
activities;
itinerary;
programme components;
participant details; or
other Booking arrangements.
All amendment requests are subject to availability and the applicable terms of Sportsmedia Indonesia and relevant suppliers. 16.10 Amendment FeesAn amendment may result in additional costs, including:
supplier amendment fees;
airline rebooking charges;
fare differences;
accommodation rate differences;
administrative costs;
transportation changes; or
other reasonable costs arising from the requested amendment.
Sportsmedia Indonesia will inform the Customer of material additional costs before implementing an amendment where reasonably practicable. 16.11 Reduction in Number of TravellersA reduction in the number of Travellers may affect the overall price of a Booking because group rates, minimum numbers, room allocations, transportation arrangements, or programme costs may change. The Customer may therefore be required to pay applicable supplier charges or reasonable additional costs resulting from a reduction in group size. Any refund resulting from a reduction in the number of Travellers will depend on the applicable Booking and supplier conditions. 16.12 Increase in Number of TravellersRequests to add Travellers are subject to availability. Additional Travellers may be charged at the applicable rate at the time the additional places are confirmed. Additional costs may arise from increased accommodation, transportation, activities, meals, tickets, insurance, or other Services. 16.13 Change of TravellerA Customer may request to replace one Traveller with another person, subject to:
supplier rules;
ticketing restrictions;
visa and immigration requirements;
programme eligibility;
age requirements;
insurance requirements;
availability; and
applicable law.
A change of Traveller may incur additional fees or may not be permitted for certain Services. 16.14 Refund AssessmentWhere a refund is applicable, Sportsmedia Indonesia will assess the amount based on:a. amounts actually received from the Customer;b. amounts already paid or committed to suppliers;c. amounts recoverable from suppliers;d. cancellation charges;e. Services already provided;f. applicable taxes and government charges;g. payment processing costs where legally permissible; andh. any other amount properly payable under the Booking. 16.15 Refunds to CustomersWhere Sportsmedia Indonesia is required to provide a refund, the refund will generally be made using the original payment method, unless otherwise agreed or reasonably necessary. Sportsmedia Indonesia will endeavour to process eligible refunds within a reasonable period after the relevant amount has been confirmed and any required supplier recovery has been completed. 16.16 Supplier RefundsWhere a refund depends on money being returned by an airline, hotel, venue, insurer, activity provider, educational institution, or other supplier, Sportsmedia Indonesia may need to wait for the supplier to process the relevant refund. Sportsmedia Indonesia will use reasonable efforts to follow up on recoverable amounts. 16.17 Credit Instead of RefundWhere appropriate, Sportsmedia Indonesia may offer a travel credit, programme credit, or other credit instead of a cash refund. A credit will only replace a refund where:
the Customer agrees to the arrangement; or
the relevant Booking terms or applicable law permit such treatment.
The validity period, permitted use, transferability, and other conditions of the credit will be communicated to the Customer. 16.18 Refunds for Services Not ProvidedWhere a Service has not been provided and the Customer is legally entitled to a refund, Sportsmedia Indonesia will process the applicable refund in accordance with the Booking arrangements and applicable law. Sportsmedia Indonesia will not retain an amount that it is legally required to return. 16.19 Services Already ProvidedWhere part of a Booking has already been provided before cancellation, any refund will take into account the value and cost of Services already delivered. Amounts properly paid to suppliers for Services already provided may not be recoverable. 16.20 Cancellation by Sportsmedia IndonesiaSportsmedia Indonesia may cancel a Booking where reasonably necessary, including where:
a supplier becomes unable to provide a material Service;
the programme becomes impracticable;
minimum participant requirements are not met;
required permits or approvals are not obtained;
safety concerns arise;
a Force Majeure Event occurs;
the Customer materially breaches these Terms; or
cancellation is otherwise permitted under the Booking arrangements or applicable law.
Where Sportsmedia Indonesia cancels a Booking, it will inform the Customer as soon as reasonably practicable and explain the available options. 16.21 Alternatives Following Cancellation by Sportsmedia IndonesiaWhere Sportsmedia Indonesia cancels a Booking, it may offer one or more of the following options, where reasonably available:
an alternative date;
an alternative itinerary;
alternative accommodation;
an alternative activity;
a replacement programme;
a credit; or
a refund of amounts legally refundable.
The Customer is not required to accept an alternative arrangement where applicable law provides a right to a refund or other remedy. 16.22 Material ChangesSportsmedia Indonesia may need to make changes to a Booking due to circumstances beyond its reasonable control or changes imposed by suppliers. Where a change is material, Sportsmedia Indonesia will provide reasonable information to the Customer and, where appropriate, offer available alternatives. The Customer's rights in relation to a material change will be determined by the applicable Booking terms and Indonesian law. 16.23 Flight Changes and Airline DecisionsAirlines may change flight schedules, routes, aircraft, seat allocations, or other arrangements. Where such changes are made by an airline, Sportsmedia Indonesia will, where reasonably practicable, assist the Customer in communicating with the airline or arranging available alternatives. Additional costs or refund rights will depend on the airline's applicable conditions and Indonesian law. 16.24 Accommodation ChangesHotels and accommodation providers may occasionally change room types, facilities, operating arrangements, or other aspects of accommodation. Where a material change occurs, Sportsmedia Indonesia will seek a reasonable alternative where practicable.Any refund or adjustment will depend on the circumstances, supplier policies, and applicable law. 16.25 Event, Competition, and Programme CancellationSports events, competitions, educational programmes, concerts, exhibitions, and other activities may be cancelled, postponed, relocated, or materially changed by their organisers. Sportsmedia Indonesia will communicate relevant information to Customers when reasonably practicable and will seek available alternatives where appropriate. Refunds will depend on the organiser's refund policy, amounts recoverable by Sportsmedia Indonesia, the applicable Booking terms, and Indonesian law. 16.26 Visa and Immigration IssuesFailure to obtain a visa, travel authorisation, immigration approval, or other required travel document does not automatically entitle the Customer to a refund. Customers are responsible for meeting applicable entry and immigration requirements unless Sportsmedia Indonesia has expressly undertaken responsibility for a specific part of the process. Where a visa or immigration application is refused, any refund will be determined by the applicable Booking terms, supplier policies, and law. 16.27 Customer No-ShowIf a Traveller fails to appear for a scheduled flight, accommodation booking, activity, programme, or other Service without prior notice, the booking may be treated as a no-show. No-show consequences may include loss of the relevant Service and applicable supplier charges, subject to the Booking terms and applicable law. 16.28 Late Arrival or Early DepartureWhere a Traveller arrives late, leaves a programme early, or voluntarily fails to use part of the Services, the unused portion will not automatically be refundable. Any refund or credit will depend on the applicable supplier terms, the reason for the change, and applicable law. 16.29 Customer's Personal CircumstancesCancellation or amendment caused by personal circumstances, including illness, family emergencies, work commitments, personal reasons, or changes of mind, will generally be handled under the applicable cancellation and amendment terms. Customers are encouraged to obtain appropriate travel insurance covering such circumstances. 16.30 Documentation and EvidenceSportsmedia Indonesia may reasonably request supporting documents when assessing a cancellation, amendment, refund, or credit request. Such documents may include:
medical certificates;
death certificates;
insurance documents;
airline notices;
government restrictions;
visa refusal documents;
supplier correspondence; or
other relevant evidence.
16.31 Administrative ProcessingSportsmedia Indonesia may require reasonable administrative time to calculate cancellation charges, obtain supplier confirmations, process refunds, or arrange alternative Services. The Customer will be informed of material delays where reasonably practicable. 16.32 No Double RecoveryA Customer shall not be entitled to recover the same loss twice from Sportsmedia Indonesia, a supplier, an insurer, or another party. Where a Customer receives compensation, reimbursement, or a refund from another source for the same loss, the Customer must disclose this where relevant to the assessment of a claim. 16.33 Insurance ClaimsWhere a loss is covered by travel insurance, the Customer should submit the relevant claim to the insurer.Sportsmedia Indonesia may provide reasonable documentation or confirmation required to support a legitimate insurance claim. However, Sportsmedia Indonesia does not guarantee that an insurer will accept or pay a claim. 16.34 Payment Processing and CurrencyWhere refunds are made, the amount may be affected by the original payment method, currency conversion, exchange rates, banking charges, or payment provider requirements, subject to applicable law. Sportsmedia Indonesia will not intentionally use currency conversion or processing arrangements to reduce a refund that is legally due to the Customer. 16.35 Refunds to Third-Party PayersWhere a Booking has been paid for by a sponsor, school, university, employer, federation, government body, or other third party, Sportsmedia Indonesia may return any applicable refund to the original payer unless otherwise agreed or required by law. 16.36 Sponsorship and Institutional BookingsWhere a Booking is funded or sponsored by a third party, cancellation, amendment, refund, and credit arrangements may also be subject to the written agreement between Sportsmedia Indonesia and the sponsoring or funding organisation. Where appropriate, Sportsmedia Indonesia will communicate the applicable arrangements to the relevant Customer or Traveller. 16.37 Customer Disputes Regarding ChargesIf a Customer believes that a cancellation charge, amendment fee, or other amount has been incorrectly applied, the Customer may submit a written request for review. Sportsmedia Indonesia will review the matter in good faith and provide a reasonable explanation based on the applicable Booking terms and available documentation. 16.38 Compliance with Indonesian LawNothing in this Chapter is intended to exclude, restrict, or reduce any mandatory rights of Customers under Indonesian law. Where a mandatory provision of Indonesian law applies to cancellation, amendment, refund, compensation, or other financial rights, that provision shall prevail to the extent of any inconsistency with these Terms. 16.39 Changes to Cancellation TermsSpecific cancellation or amendment conditions may vary between Bookings depending on the nature of the Services and the requirements of third-party suppliers. Any specific conditions applicable to a Booking will be communicated to the Customer through the relevant quotation, Booking Confirmation, invoice, agreement, or other written communication. 16.40 Final Cancellation and Refund StatementSportsmedia Indonesia aims to provide Customers with clear and transparent information regarding cancellation, amendment, refund, and credit arrangements before a Booking is confirmed. Customers are encouraged to carefully review the applicable Booking Confirmation and cancellation conditions before making payment. Where there is any inconsistency between these Terms and a mandatory requirement of Indonesian law, the mandatory legal requirement shall prevail. CHAPTER XVIILIABILITY, CUSTOMER RESPONSIBILITIES AND LIMITATION OF LIABILITY 17.1 General Principle of LiabilitySportsmedia Indonesia is responsible for providing the Services in accordance with the confirmed Booking and the obligations that legally apply under Indonesian law. Sportsmedia Indonesia will use reasonable efforts to provide the Services professionally, safely, and in accordance with the arrangements agreed with the Customer. 17.2 Customer ResponsibilitiesThe Customer is responsible for:a. providing true, complete, and accurate information;b. providing required documents in a timely manner;c. making payments in accordance with the agreed schedule;d. ensuring that all Travellers meet applicable travel requirements;e. complying with applicable laws and regulations;f. following safety instructions and the rules of Service Providers;g. taking reasonable care of personal belongings and travel documents; andh. providing reasonable cooperation to Sportsmedia Indonesia throughout the provision of the Services. 17.3 Accuracy of InformationThe Customer is responsible for the accuracy of the information provided to Sportsmedia Indonesia. Incorrect information concerning names, dates of birth, passport numbers, nationality, special requirements, health information, or other important information may result in additional costs, delays, or the inability to provide certain Services. 17.4 Travel DocumentsThe Customer and each Traveller are responsible for ensuring that they hold all required and valid travel documents, including, where applicable:
passports;
visas;
travel authorisations;
identification documents;
parental or guardian authorisations;
health certificates;
insurance documents; and
other documents required by the destination country or Service Provider.
17.5 Visa and Immigration RequirementsThe Customer is responsible for complying with applicable visa, immigration, and entry requirements. Sportsmedia Indonesia may provide information or administrative assistance where expressly agreed, but decisions regarding the granting of visas or permission to enter a country remain solely with the relevant competent authorities. 17.6 Changes to Travel RequirementsTravel, visa, health, immigration, and security requirements may change from time to time. The Customer is responsible for ensuring that their information and documents continue to meet applicable requirements before and during the trip. 17.7 Compliance with LawsThe Customer and Travellers must comply with the laws and regulations applicable in their country of departure, transit countries, destination countries, and locations where the Services are provided. Sportsmedia Indonesia is not responsible for consequences arising from a Customer or Traveller violating applicable laws. 17.8 Traveller ConductThe Customer and Travellers must behave reasonably, respectfully, and appropriately towards:
Sportsmedia Indonesia personnel;
Service Provider personnel;
other Travellers;
local communities;
educational institutions;
sports organisations;
venues;
property; and
local laws and customs.
17.9 Unacceptable ConductSportsmedia Indonesia or a Service Provider may take reasonable action where a Traveller's conduct:
places themselves or another person at risk;
seriously disrupts other participants;
causes damage to property;
violates applicable laws;
seriously interferes with the programme;
breaches venue or Service Provider rules; or
creates an unreasonable risk.
17.10 Termination of Participation Due to ConductIn serious circumstances, a Traveller may be required to discontinue participation in an activity or programme. Where such termination results from the conduct of the Customer or Traveller, any additional costs arising as a result may be the responsibility of the Customer, to the extent permitted by law. 17.11 Damage to PropertyThe Customer is responsible for damage to hotels, venues, vehicles, sports facilities, educational institutions, or other property directly caused by the acts or omissions of the Customer or Traveller. Sportsmedia Indonesia may assist with communication or facilitate discussions with the relevant Service Provider where reasonably necessary. 17.12 Personal BelongingsThe Customer and Travellers are responsible for taking reasonable care of personal belongings, money, documents, electronic devices, sporting equipment, and other valuables during travel. Travellers are encouraged to use available storage facilities and follow security instructions provided by Service Providers. 17.13 Lost or Damaged BaggageLoss, delay, or damage to baggage occurring during air travel or transportation Services will generally be the responsibility of the relevant transport operator under applicable rules. Sportsmedia Indonesia may assist the Customer in reporting the matter or submitting a claim to the relevant party where reasonably practicable. 17.14 Prohibited ItemsCustomers and Travellers must not carry items prohibited by law, aviation regulations, immigration requirements, venue rules, or Service Provider policies. The Customer is responsible for consequences arising from carrying prohibited or restricted items. 17.15 Customer DelaysThe Customer is responsible for arriving at the specified time and location. A delay by the Customer that results in a missed flight, transportation service, activity, visit, match, or other Service may result in additional costs. 17.16 Duty to Mitigate LossWhere a problem occurs during a trip, the Customer must take reasonable steps to reduce or mitigate any resulting loss.The Customer should also promptly notify Sportsmedia Indonesia of any material issue affecting the Services. 17.17 Duty to Report ProblemsWhere the Customer experiences a problem with a Service, the Customer should report it to Sportsmedia Indonesia or the relevant Service Provider as soon as reasonably practicable. Prompt notification allows Sportsmedia Indonesia or the relevant Service Provider a reasonable opportunity to remedy or minimise the impact of the problem. 17.18 Responsibility for Third-Party Service ProvidersSportsmedia Indonesia may use independent third-party Service Providers to deliver parts of the Services, including:
airlines;
hotels;
transportation companies;
venues;
tour operators;
activity providers;
educational institutions;
sports organisations;
insurance providers;
payment providers; and
other service providers.
Each Service Provider remains responsible for the part of the Services that falls within its contractual or legal responsibility. 17.19 Sportsmedia Indonesia as Arranger or IntermediaryFor certain Bookings, Sportsmedia Indonesia may act as an arranger, agent, facilitator, or intermediary between the Customer and a Service Provider. In such circumstances, Sportsmedia Indonesia will provide relevant information regarding the Services based on information available from the Service Provider. 17.20 Third-Party InformationSportsmedia Indonesia may rely on information provided by third-party Service Providers. Sportsmedia Indonesia will use reasonable efforts to communicate accurate information but is not responsible for changes or inaccuracies that are outside its reasonable control. 17.21 Limitation of LiabilityTo the extent permitted by Indonesian law, Sportsmedia Indonesia shall not be responsible for losses that:a. are caused by the acts or omissions of the Customer or Traveller;b. are caused by a third party outside the reasonable control of Sportsmedia Indonesia;c. arise from a Force Majeure Event;d. arise because the Customer failed to meet applicable travel requirements;e. arise from inaccurate or incomplete information provided by the Customer; orf. could not reasonably have been prevented or avoided. 17.22 Indirect or Consequential LossTo the extent permitted by applicable law, Sportsmedia Indonesia shall not be liable for indirect or consequential losses that do not directly result from a failure by Sportsmedia Indonesia to perform its own obligations. However, this provision is not intended to exclude liability that cannot legally be excluded under Indonesian law. 17.23 Liability That Cannot Be ExcludedNothing in these Booking Terms is intended to exclude or limit any liability of Sportsmedia Indonesia that cannot legally be excluded or limited under Indonesian law. Where mandatory Indonesian law provides specific consumer rights or liability obligations, those provisions shall continue to apply. 17.24 Responsibility for SafetySportsmedia Indonesia will take reasonable measures to support the safety of Customers and Travellers during Services that are within the reasonable control of Sportsmedia Indonesia. However, Customers acknowledge that travel, sports, physical activities, transportation, and other activities may naturally involve certain risks. 17.25 Children and Travellers Under 18For Travellers under the age of 18, the Parent or Legal Guardian remains responsible for:
compliance with travel requirements;
travel documentation;
health information;
required consent;
participant conduct;
special requirements; and
decisions concerning the participant, to the extent permitted by law.
17.26 Group Leader ResponsibilitiesWhere a Booking is made by a Group Leader, the Group Leader is responsible for assisting in ensuring that members of the group:
receive important information;
meet applicable travel requirements;
arrive according to the agreed schedule;
comply with programme rules;
hold required documents; and
follow safety instructions.
The responsibilities of a Group Leader do not remove the individual legal rights or responsibilities of each Traveller. 17.27 Sponsorship and Institutional BookingsFor Bookings funded by sponsors, schools, universities, sports federations, National Olympic Committees, government bodies, companies, or other organisations, the allocation of responsibilities may be further defined in a written agreement. Where there is a conflict between these Booking Terms and such specific written agreement, the specific agreement shall apply to the extent that it does not conflict with mandatory applicable law. 17.28 Duty to CooperateThe Customer must provide reasonable cooperation to Sportsmedia Indonesia in resolving problems, claims, travel changes, emergencies, or complaints. A failure to provide reasonable cooperation may affect Sportsmedia Indonesia's ability to assist in resolving a matter. 17.29 Claims Against Third PartiesWhere a loss is the responsibility of a Service Provider or another third party, the Customer may be directed to submit the relevant claim directly to that party. Sportsmedia Indonesia may provide reasonable administrative assistance where practicable. 17.30 No Double RecoveryWhere Sportsmedia Indonesia receives a refund, compensation, or payment from a third party that directly relates to a Customer's loss, that amount will be taken into account when determining any amount that remains recoverable by the Customer. This is intended to prevent double recovery for the same loss. 17.31 Responsibility for Digital InformationThe Customer is responsible for ensuring that information or documents submitted electronically to Sportsmedia Indonesia are not intentionally false, incomplete, or knowingly harmful. Sportsmedia Indonesia will implement reasonable security measures for digital information in accordance with its Privacy Policy and applicable Personal Data Protection requirements. 17.32 System DisruptionsSportsmedia Indonesia shall not be responsible for temporary interruptions affecting its website, communication systems, payment services, email, or other technology systems where such interruption is caused by circumstances outside its reasonable control. Sportsmedia Indonesia will use reasonable efforts to restore affected services within a reasonable period. 17.33 Reliance on Customer InformationWhere Sportsmedia Indonesia takes action based on information provided by the Customer, Sportsmedia Indonesia may reasonably rely on that information unless it knows, or reasonably should know, that the information is inaccurate. 17.34 Limitations Shall Not Apply UnreasonablyAny limitation of liability contained in this Chapter shall be interpreted reasonably and consistently with Indonesian law. Nothing in these Terms is intended to give Sportsmedia Indonesia the right to avoid responsibility for an act or omission for which it is legally required to remain responsible. 17.35 Consumer Protection ComplianceSportsmedia Indonesia is committed to providing the Services while respecting consumer rights under applicable Indonesian laws and regulations. Nothing in this Chapter is intended to remove or unlawfully restrict any consumer rights provided by law. 17.36 Claims and Dispute ResolutionWhere a claim or dispute arises regarding liability, the parties shall first seek to resolve the matter amicably and in good faith. If the matter cannot be resolved, the dispute resolution mechanism set out in the relevant Dispute Resolution Chapter shall apply. 17.37 Relationship with Other ChaptersThis Chapter shall be read together with:
the cancellation and refund provisions;
the Force Majeure provisions;
the health and insurance provisions;
the Privacy Policy;
the Booking Confirmation; and
any other specific terms applicable to the Booking.
17.38 No Automatic Transfer of LiabilityThe use of third-party Service Providers by Sportsmedia Indonesia does not automatically remove or transfer any responsibility that legally belongs to Sportsmedia Indonesia itself. 17.39 Compliance with Indonesian LawAll provisions concerning liability and limitation of liability in this Chapter are subject to Indonesian law. Where a mandatory provision of Indonesian law conflicts with any provision of this Chapter, the mandatory legal provision shall prevail to the extent of the inconsistency. 17.40 Final Statement on LiabilitySportsmedia Indonesia is committed to providing its Services professionally, transparently, and in good faith. Sportsmedia Indonesia and its Customers each have a responsibility to perform their respective obligations reasonably and in accordance with applicable law. Nothing in this Chapter is intended to reduce the Customer's legal rights or release Sportsmedia Indonesia from any liability that cannot legally be excluded. CHAPTER XVIIIINSURANCE, HEALTH, MEDICAL CONDITIONS AND EMERGENCY ASSISTANCE 18.1 General PrincipleSportsmedia Indonesia recognises that travel, sports activities, educational programmes, group travel, and other Services may involve health, safety, medical, and other risks. Customers and Travellers are responsible for taking reasonable steps to ensure that they are appropriately prepared and protected against risks associated with their Booking. Where appropriate, Customers are strongly encouraged to obtain suitable travel insurance before commencing their journey. 18.2 Travel InsuranceUnless expressly stated otherwise in writing, travel insurance is not automatically included in the price of a Booking. Customers are responsible for arranging appropriate insurance coverage for themselves and their Travellers. Insurance should, where relevant, provide appropriate coverage for:
medical expenses;
emergency medical treatment;
hospitalisation;
medical evacuation;
repatriation;
cancellation;
travel interruption;
lost or delayed baggage;
personal belongings;
personal liability; and
sports or adventure activities undertaken during the programme.
18.3 Sports and High-Risk ActivitiesCertain activities may involve a higher level of physical or operational risk, including:
cycling and BMX;
water sports;
winter sports;
adventure activities;
outdoor activities;
combat or contact sports;
motor sports;
climbing;
trekking; and
other physically demanding activities.
Customers must ensure that their insurance coverage is suitable for the specific activities included in their Booking. 18.4 Customer Responsibility for InsuranceThe Customer remains responsible for reviewing the terms, exclusions, coverage limits, deductibles, and conditions of any insurance policy purchased. Sportsmedia Indonesia does not guarantee that a particular insurance policy will cover a particular loss, injury, illness, cancellation, or activity. 18.5 Pre-Existing Medical ConditionsCustomers and Travellers should disclose relevant pre-existing medical conditions to their insurer where required by the applicable insurance policy. Where a medical condition may materially affect the Traveller's ability to participate safely in a programme or activity, the Customer should inform Sportsmedia Indonesia in advance where reasonably necessary. 18.6 Medical and Health InformationSportsmedia Indonesia may collect health-related or medical information where reasonably necessary to:
arrange appropriate Services;
address dietary or accessibility requirements;
support participant safety;
respond to emergencies;
communicate relevant information to authorised Service Providers; or
comply with legal obligations.
Any processing of health-related Personal Data will be handled in accordance with the applicable Personal Data Protection laws and Sportsmedia Indonesia's Privacy Policy. 18.7 Consent and AuthorisationWhere health or medical information is provided on behalf of another person, the person providing the information must have appropriate authority to do so. For Travellers under 18, relevant consent or authorisation should be provided by a Parent or Legal Guardian or another person legally authorised to act on their behalf. 18.8 Medical FitnessCustomers and Travellers are responsible for determining whether they are medically and physically fit to participate in the Services they have booked. Where a particular activity or programme requires medical clearance, Sportsmedia Indonesia may request appropriate evidence before participation. 18.9 Medical AdviceSportsmedia Indonesia is not a medical provider and does not provide medical diagnosis, medical treatment, or professional medical advice. Customers should obtain advice from a suitably qualified medical professional where they have concerns regarding their fitness to travel or participate in an activity. 18.10 Emergency Medical AssistanceWhere a medical emergency occurs during a programme, Sportsmedia Indonesia or its authorised representatives may take reasonable steps to obtain emergency assistance. Such assistance may include:
contacting emergency services;
contacting a medical facility;
arranging transportation to a hospital;
notifying the relevant Group Leader, Parent, or Legal Guardian;
contacting an insurer; or
communicating with an authorised emergency contact.
18.11 Emergency Decision-MakingIn an emergency where immediate action is reasonably necessary and the Traveller cannot provide instructions, Sportsmedia Indonesia or its authorised representatives may contact emergency services or seek appropriate medical assistance. Sportsmedia Indonesia will act reasonably based on the circumstances known at the time. 18.12 Medical CostsUnless expressly agreed otherwise, Customers remain responsible for medical expenses incurred by themselves or their Travellers. This may include:
consultations;
treatment;
medication;
hospitalisation;
ambulance services;
medical evacuation;
repatriation; and
other medical or related expenses.
Where applicable, Customers should seek reimbursement from their travel insurer. 18.13 Medical Evacuation and RepatriationWhere medical evacuation or repatriation is required, the arrangements and costs will generally depend on the relevant medical circumstances, the availability of appropriate facilities, the Customer's insurance coverage, and the decisions of qualified medical professionals and relevant authorities. Sportsmedia Indonesia may provide reasonable assistance in coordinating communications and arrangements. 18.14 Emergency Contact InformationCustomers should provide accurate and up-to-date emergency contact information for each Traveller where such information is reasonably required for the programme. Customers are responsible for ensuring that emergency contact information remains current. 18.15 Emergency Contacts for MinorsFor Travellers under 18, Sportsmedia Indonesia may require emergency contact information for a Parent, Legal Guardian, Group Leader, or another authorised adult. Where appropriate, Sportsmedia Indonesia may contact such person in the event of an emergency involving the minor. 18.16 Allergies and Dietary RequirementsCustomers should inform Sportsmedia Indonesia of relevant allergies, intolerances, medical dietary requirements, religious dietary requirements, or other important dietary restrictions as early as reasonably practicable. Sportsmedia Indonesia will communicate such requirements to relevant Service Providers where appropriate.However, Sportsmedia Indonesia cannot guarantee that every supplier or facility will be able to accommodate every dietary requirement. 18.17 Accessibility and Special AssistanceCustomers should notify Sportsmedia Indonesia of any accessibility or special assistance requirements before a Booking is confirmed wherever possible. Such requirements may include:
mobility assistance;
wheelchair access;
hearing assistance;
visual assistance;
special transportation arrangements;
accommodation requirements; or
other reasonable support needs.
The availability of such assistance may depend on the facilities and capabilities of the relevant Service Provider. 18.18 Physical and Sporting RequirementsCertain sports and activities may require a specific level of physical ability, equipment, experience, or training. Customers and Travellers are responsible for informing Sportsmedia Indonesia of any relevant limitations that may affect safe participation. 18.19 Safety InstructionsTravellers must follow reasonable safety instructions issued by Sportsmedia Indonesia, instructors, coaches, guides, venue operators, transport providers, educational institutions, or other authorised personnel. Failure to follow reasonable safety instructions may result in the Traveller being prevented from participating in a particular activity where necessary for safety. 18.20 Protective EquipmentWhere protective equipment is required for an activity, Travellers must use the equipment properly and follow relevant instructions. Where the Customer is required to provide personal protective equipment, the Customer is responsible for ensuring that such equipment is appropriate and suitable for the activity. 18.21 Fitness and PreparationCustomers should ensure that Travellers are adequately prepared for the physical, environmental, and operational conditions of the programme. This may include appropriate:
clothing;
footwear;
equipment;
medication;
hydration;
physical preparation; and
other personal requirements.
18.22 MedicationTravellers who require medication during a trip are responsible for bringing an adequate supply and ensuring that the medication is legally permitted in the relevant destination and transit countries. Sportsmedia Indonesia does not normally administer or manage personal medication unless this responsibility has been expressly agreed in writing and appropriate arrangements are in place. 18.23 Confidentiality of Health InformationSportsmedia Indonesia will treat health and medical information as Personal Data and will take reasonable measures to protect it from unauthorised access, use, disclosure, alteration, or loss. Health information will only be shared with relevant parties where reasonably necessary and permitted by applicable law. 18.24 Disclosure in an EmergencyNotwithstanding confidentiality obligations, Sportsmedia Indonesia may disclose relevant health or emergency information where reasonably necessary to protect the life, health, or safety of a Traveller or another person, or where required or permitted by law. 18.25 Communicable Diseases and Public Health MeasuresCustomers and Travellers must comply with applicable public health requirements, including requirements relating to communicable diseases, vaccinations, testing, quarantine, isolation, or other health measures imposed by relevant authorities. Such requirements may vary between countries and may change before or during travel. 18.26 Failure to Meet Health RequirementsWhere a Traveller fails to meet a mandatory health, vaccination, testing, or other public health requirement, the Traveller may be unable to travel or participate in certain Services. Any resulting cancellation, amendment, or additional cost will be handled in accordance with the applicable Booking terms, supplier policies, insurance coverage, and Indonesian law. 18.27 Medical Emergencies During International TravelDuring international travel, medical treatment may be subject to the laws, healthcare systems, costs, and procedures of the destination country. Customers are responsible for ensuring that their insurance coverage is appropriate for international medical treatment where relevant. 18.28 Emergency Assistance Does Not Guarantee OutcomeAny assistance provided by Sportsmedia Indonesia during a medical or other emergency is intended to facilitate access to appropriate support. Sportsmedia Indonesia does not guarantee the outcome of medical treatment, emergency response, hospital services, insurance claims, evacuation, or repatriation. 18.29 Parents and Legal GuardiansParents and Legal Guardians remain responsible for providing accurate medical and emergency information concerning Travellers under 18. They must also ensure that any necessary consent, authorisation, medication instructions, and emergency arrangements are properly provided before departure. 18.30 Group Leader and Institutional ResponsibilitiesFor school, university, federation, corporate, government, or other institutional programmes, the relevant Group Leader or authorised institution may have additional responsibilities concerning participant health, supervision, consent, and emergency communication. Such responsibilities may be specified in a separate agreement or programme documentation. 18.31 Emergency CommunicationDuring an emergency, Sportsmedia Indonesia may use available communication channels to contact:
the Traveller;
Group Leader;
Parent or Legal Guardian;
emergency contact;
Service Provider;
insurer;
medical provider;
relevant authority; or
other authorised person.
18.32 Emergency Information Provided by CustomersCustomers are responsible for ensuring that emergency information provided to Sportsmedia Indonesia is accurate, complete, and up to date. Sportsmedia Indonesia will not be responsible for difficulties caused by inaccurate, incomplete, or outdated emergency information supplied by the Customer. 18.33 Health-Related Changes to a ProgrammeWhere a Traveller's health or medical condition requires a change to the itinerary or programme, Sportsmedia Indonesia may reasonably modify participation arrangements where necessary for safety. Any resulting additional costs or refund entitlement will depend on the circumstances, supplier terms, insurance coverage, and applicable law. 18.34 Refusal or Restriction of ParticipationSportsmedia Indonesia or a relevant Service Provider may reasonably restrict or refuse participation in an activity where there is a legitimate safety concern, medical concern, legal restriction, or failure to meet mandatory participation requirements. Such action will be taken based on the circumstances and applicable requirements. 18.35 No DiscriminationSportsmedia Indonesia will seek to handle health, disability, accessibility, and special assistance requirements fairly and respectfully. Any restrictions on participation should be based on legitimate safety, legal, operational, or Service Provider requirements and not on unlawful discrimination. 18.36 Relationship with Travel InsuranceThe availability of assistance from Sportsmedia Indonesia does not replace the Customer's responsibility to maintain appropriate travel insurance. Insurance claims remain subject to the terms, exclusions, conditions, and assessment procedures of the relevant insurer. 18.37 Relationship with Liability ProvisionsThis Chapter shall be read together with the liability and limitation of liability provisions in Chapter XVII.Nothing in this Chapter is intended to exclude or limit any liability that cannot legally be excluded or limited under Indonesian law. 18.38 Compliance with Personal Data Protection LawThe collection, use, storage, disclosure, and other processing of health, medical, emergency, and other Personal Data will be carried out in accordance with applicable Indonesian Personal Data Protection laws and Sportsmedia Indonesia's Privacy Policy. 18.39 Compliance with Indonesian LawAll provisions in this Chapter are subject to applicable Indonesian law. Where mandatory legal requirements apply to health, safety, medical assistance, consumer protection, Personal Data Protection, or other matters addressed in this Chapter, those requirements shall prevail to the extent of any inconsistency. 18.40 Final Statement on Health, Insurance and Emergency AssistanceSportsmedia Indonesia is committed to supporting the health, safety, and wellbeing of Customers and Travellers through reasonable planning, communication, and emergency assistance. However, Customers remain responsible for obtaining appropriate insurance, providing accurate health and emergency information, complying with applicable health and safety requirements, and taking reasonable steps to protect their own health and safety during travel and participation in the Services. CHAPTER XIXFORCE MAJEURE, UNAVOIDABLE EVENTS AND MAJOR DISRUPTIONS 19.1 General PrincipleSportsmedia Indonesia shall not be responsible for a failure, delay, interruption, modification, or inability to provide any part of the Services where such circumstances arise from an event or circumstance that is beyond the reasonable control of Sportsmedia Indonesia. Such circumstances are referred to in these Booking Terms as a Force Majeure Event. 19.2 Definition of Force Majeure EventA Force Majeure Event means an event or circumstance that:a. occurs beyond the reasonable control of Sportsmedia Indonesia;b. could not reasonably have been prevented or avoided;c. materially affects the provision of the Services; andd. makes performance impossible, impracticable, unsafe, or materially disrupted. 19.3 Examples of Force Majeure EventsForce Majeure Events may include, but are not limited to:
natural disasters;
earthquakes;
tsunamis;
volcanic eruptions;
floods;
severe storms;
extreme weather conditions;
fires;
epidemics or pandemics;
public health emergencies;
war;
terrorism;
civil unrest;
riots;
strikes or industrial action;
government restrictions;
changes in immigration requirements;
border closures;
travel bans;
airport closures;
cancellation or significant disruption of transportation services;
security threats;
political instability;
acts of government or public authorities;
major infrastructure failures;
widespread telecommunications or technology failures; or
other events beyond the reasonable control of Sportsmedia Indonesia.
19.4 Assessment of Force MajeureWhether an event constitutes a Force Majeure Event will depend on the circumstances of the particular case. Sportsmedia Indonesia will consider the nature of the event, its impact on the Services, available alternatives, safety considerations, and the reasonable ability of Sportsmedia Indonesia or relevant Service Providers to continue performing the Services. 19.5 International Travel DisruptionsInternational travel may be affected by events occurring in countries outside Indonesia. Where an event in a destination, transit country, or other relevant location materially affects the Booking, Sportsmedia Indonesia may take reasonable steps to modify or reorganise the Services. 19.6 Government RestrictionsWhere a government or competent authority introduces restrictions affecting travel or the provision of Services, Sportsmedia Indonesia may be required to modify, postpone, suspend, or cancel affected arrangements. Such restrictions may include:
travel bans;
entry restrictions;
quarantine requirements;
border closures;
curfews;
restrictions on public gatherings;
venue closures;
health requirements; or
other mandatory measures.
19.7 Transportation DisruptionsWhere flights, trains, buses, ferries, or other transportation services are delayed, cancelled, suspended, diverted, or materially disrupted due to circumstances outside the reasonable control of Sportsmedia Indonesia, Sportsmedia Indonesia may assist the Customer in seeking reasonable alternative arrangements. Any additional costs will be handled in accordance with the applicable Booking terms and the policies of the relevant Service Provider. 19.8 Airline and Transport Provider DecisionsAirlines and other transportation providers may make operational decisions independently of Sportsmedia Indonesia. These may include changes to:
schedules;
routes;
aircraft;
departure times;
arrival times;
baggage policies;
capacity; or
cancellation arrangements.
Sportsmedia Indonesia will communicate material changes to Customers where information is reasonably available. 19.9 Accommodation DisruptionsWhere accommodation becomes unavailable due to a Force Majeure Event or circumstances outside the reasonable control of Sportsmedia Indonesia, Sportsmedia Indonesia may seek alternative accommodation of a reasonably comparable standard, subject to availability. Where a comparable alternative is not reasonably available, Sportsmedia Indonesia may discuss alternative arrangements with the Customer. 19.10 Venue and Activity ClosuresA venue, stadium, sports facility, educational institution, attraction, or activity provider may be required to close or modify its operations due to circumstances outside the control of Sportsmedia Indonesia. Where this occurs, Sportsmedia Indonesia may seek a reasonable alternative where practicable. 19.11 Sports Events and CompetitionsSports competitions, matches, tournaments, training camps, and sporting events may be postponed, rescheduled, relocated, cancelled, or modified by the relevant organiser, federation, league, venue, or governing body.Sportsmedia Indonesia does not control such decisions. Where such a change affects a Booking, Sportsmedia Indonesia will use reasonable efforts to inform Customers and assist with available alternatives. 19.12 Educational ProgrammesEducational programmes, school visits, university visits, workshops, seminars, conferences, and institutional activities may be changed, postponed, or cancelled by the relevant institution or organiser. Where this occurs for reasons beyond the reasonable control of Sportsmedia Indonesia, Sportsmedia Indonesia may seek reasonable alternative arrangements where practicable. 19.13 Safety ConsiderationsSportsmedia Indonesia may modify or suspend a programme where continuing the Services would create an unreasonable risk to the safety or wellbeing of Customers, Travellers, staff, or other persons. Safety considerations may take priority over the original itinerary where reasonably necessary. 19.14 Changes to ItineraryWhere a Force Majeure Event affects an itinerary, Sportsmedia Indonesia may make reasonable changes to:
routes;
schedules;
activities;
accommodation;
transportation;
venues;
programme locations; or
other components of the Services.
Sportsmedia Indonesia will seek to preserve the overall purpose and value of the programme where reasonably practicable. 19.15 Equivalent AlternativesWhere an original Service becomes unavailable, Sportsmedia Indonesia may offer an alternative Service that is reasonably comparable in purpose, nature, or value, subject to availability. The Customer will be informed of any material differences where reasonably practicable. 19.16 Customer Acceptance of Reasonable ChangesWhere a change is reasonably necessary due to a Force Majeure Event and does not materially alter the essential nature of the Booking, the Customer is expected to cooperate with the revised arrangements. 19.17 Material ChangesWhere a Force Majeure Event results in a material change to the essential nature of the Booking, Sportsmedia Indonesia will communicate the available options to the Customer. Depending on the circumstances, these may include:
accepting an alternative arrangement;
postponing the Booking;
receiving an applicable credit; or
receiving a refund where applicable under the Booking terms and applicable law.
19.18 Refunds Following Force MajeureAny refund resulting from a Force Majeure Event will depend on:
amounts actually recoverable from Service Providers;
applicable supplier cancellation policies;
amounts already paid to third parties;
the nature of the Booking;
the specific circumstances of the Force Majeure Event; and
applicable Indonesian law.
19.19 Non-Refundable Third-Party CostsCertain costs paid to third-party Service Providers may be non-refundable. Where Sportsmedia Indonesia has already paid or become legally committed to such costs, the Customer's refund or credit entitlement may be affected to the extent permitted by applicable law and the agreed Booking terms. 19.20 Supplier RefundsWhere Sportsmedia Indonesia receives a refund, credit, or other financial recovery from a Service Provider specifically relating to the Customer's Booking, Sportsmedia Indonesia will take that recovery into account when determining any amount payable or refundable to the Customer. 19.21 No Guaranteed AlternativeSportsmedia Indonesia does not guarantee that an alternative flight, hotel, venue, activity, or other Service will always be available following a Force Majeure Event. Availability may depend on capacity, location, timing, cost, government restrictions, and decisions made by third-party Service Providers. 19.22 Additional CostsWhere alternative arrangements are requested by the Customer and result in additional costs, such costs may be payable by the Customer where they are not otherwise covered by the original Booking, insurance, Service Provider, or applicable law. Sportsmedia Indonesia will communicate material additional costs before committing the Customer to such arrangements where reasonably practicable. 19.23 Customer's Failure to TravelIf the Customer decides not to travel because of concerns regarding a potential Force Majeure Event, but the relevant Services remain available and have not been materially disrupted, the normal cancellation and refund provisions may apply. Customers should therefore carefully consider available insurance coverage before making a decision not to travel. 19.24 Government Advice and Travel WarningsCustomers should consider official travel advisories and requirements issued by relevant government authorities.Sportsmedia Indonesia may provide information concerning known travel restrictions or disruptions but does not provide government, legal, security, or medical advice. 19.25 Security and Political EventsWhere political instability, civil unrest, terrorism, security threats, armed conflict, or similar events affect the safety or practical operation of a programme, Sportsmedia Indonesia may modify, suspend, postpone, or cancel affected Services where reasonably necessary. 19.26 Public Health EmergenciesPublic health emergencies, including outbreaks of infectious diseases, may result in restrictions affecting travel, accommodation, events, sports programmes, educational activities, or other Services. Sportsmedia Indonesia may implement reasonable changes in response to such circumstances. 19.27 Natural DisastersWhere natural disasters or severe environmental conditions affect the destination or travel route, Sportsmedia Indonesia may modify or suspend affected Services where necessary for safety or operational reasons. 19.28 Communication During Major DisruptionsSportsmedia Indonesia will use reasonable efforts to communicate material changes caused by a Force Majeure Event through available communication channels. Customers are responsible for ensuring that their contact information remains accurate and that they remain reasonably reachable during the programme. 19.29 Customer CooperationCustomers must reasonably cooperate with alternative arrangements, emergency instructions, itinerary changes, and other reasonable measures required as a result of a Force Majeure Event. 19.30 Traveller SafetyWhere a Force Majeure Event occurs during a programme, Sportsmedia Indonesia will prioritise reasonable measures relating to the safety and wellbeing of Travellers. This may include changes to transportation, accommodation, activities, or evacuation arrangements where appropriate. 19.31 Emergency RelocationWhere necessary for safety, Sportsmedia Indonesia may assist in arranging the relocation of Travellers to another accommodation, venue, or location. Any resulting costs will depend on the circumstances, available insurance, Service Provider arrangements, and applicable law. 19.32 Force Majeure Affecting Third PartiesA Force Majeure Event may affect a Service Provider even where Sportsmedia Indonesia itself remains operational.Where a third-party Service Provider is unable to perform its obligations because of such an event, Sportsmedia Indonesia may be required to modify the affected part of the Booking. 19.33 Force Majeure and Service Provider ContractsWhere a Service Provider's contractual terms contain specific provisions concerning Force Majeure, those provisions may affect the Customer's available remedies in relation to the affected Service. Sportsmedia Indonesia will apply such provisions consistently with the Booking and applicable law. 19.34 No Obligation to Perform the ImpossibleSportsmedia Indonesia is not required to perform an obligation that has become objectively impossible due to a Force Majeure Event, to the extent recognised by applicable law. Sportsmedia Indonesia will nevertheless use reasonable efforts to mitigate the effects of the disruption where practicable. 19.35 Duty to MitigateSportsmedia Indonesia will use reasonable efforts to reduce the impact of a Force Majeure Event on Customers and Travellers. Customers are also expected to take reasonable steps to minimise their own losses and follow reasonable instructions provided during the disruption. 19.36 Relationship with InsuranceCustomers should seek assistance from their travel insurer where a Force Majeure Event results in losses that may be covered under the applicable insurance policy. Sportsmedia Indonesia may provide reasonable documentation or administrative assistance where appropriate. 19.37 Relationship with Cancellation and Refund ProvisionsThis Chapter shall be read together with Chapter XVI — Cancellation, Amendment, Refund and Credit. Where a Force Majeure Event results in cancellation, postponement, or material alteration of a Booking, the applicable cancellation, refund, or credit provisions shall apply subject to the circumstances and applicable law. 19.38 Relationship with Liability ProvisionsThis Chapter shall also be read together with Chapter XVII — Liability, Customer Responsibilities and Limitation of Liability. Nothing in this Chapter is intended to exclude or limit any liability that cannot legally be excluded or limited under Indonesian law. 19.39 Indonesian LawThe interpretation and application of Force Majeure provisions in these Booking Terms shall be subject to Indonesian law.Where a mandatory provision of Indonesian law applies, that provision shall prevail to the extent of any inconsistency. 19.40 Final Statement on Force MajeureSportsmedia Indonesia recognises that travel and international programmes may be affected by events that cannot reasonably be predicted, prevented, or controlled. Sportsmedia Indonesia will seek to act reasonably, communicate material changes, assist Customers where practicable, and minimise disruption wherever reasonably possible. However, Customers acknowledge that certain events may make the original Services impossible, unsafe, or materially impracticable to provide. CHAPTER XXPRICES, PAYMENT, TAXES, ADDITIONAL CHARGES, AND PRICE CHANGES 20.1 Booking PriceThe price quoted by Sportsmedia Indonesia to the Customer shall be based on the details of the services set out in the proposal, quotation, invoice, booking confirmation, or other Booking documents. The price may vary depending on:
number of Travellers;
travel dates;
destination;
type of accommodation;
transportation class;
activities;
venue;
number of accompanying personnel;
special requirements;
level of service; and
other requirements of the Booking.
20.2 Prices in Proposals and QuotationsAny price stated in a proposal or quotation shall remain valid for the period specified in such document. If no validity period is stated, the quotation shall generally remain valid for 14 calendar days from the date of issuance, unless otherwise stated in writing. Such prices may still be subject to change before the Booking is confirmed if there are changes in costs imposed by Service Providers or other circumstances beyond the reasonable control of Sportsmedia Indonesia. 20.3 Price ConfirmationThe price shall become the agreed Booking price once the Customer accepts the proposal or quotation and Sportsmedia Indonesia receives the required payment or Booking confirmation in accordance with the applicable terms. Where a price requires a deposit or specific payment to secure the services, the Booking shall not be deemed fully confirmed until such requirement has been fulfilled. 20.4 CurrencyPrices may be stated in:
Indonesian Rupiah (IDR);
United States Dollars (USD);
Euro (EUR);
Pound Sterling (GBP); or
any other currency agreed in writing.
If payment is made in a currency different from the currency stated in the invoice, any currency conversion costs or exchange rate differences may be borne by the Customer. 20.5 Currency Exchange RatesFor international Bookings, costs may be affected by fluctuations in currency exchange rates. Changes in exchange rates after a quotation has been issued but before full payment may result in a price adjustment where third-party costs have not yet been fixed or paid by Sportsmedia Indonesia. 20.6 DepositsSportsmedia Indonesia may require a deposit before a Booking is confirmed. The amount and payment deadline for the deposit shall be stated in the quotation, invoice, or Booking document. The deposit may be used to secure:
flights;
accommodation;
venues;
tickets;
activities;
transportation;
experts;
coaches;
guides; or
other third-party services.
20.7 Instalment PaymentsFor certain Bookings, Sportsmedia Indonesia may provide an instalment payment arrangement. The payment schedule and amount of each instalment shall be specified in the proposal, quotation, invoice, or separate agreement. The Customer shall make each payment by the applicable due date. 20.8 Final PaymentUnless otherwise stated in writing, full payment must be received before the departure date or by the payment deadline specified in the Booking documents. Sportsmedia Indonesia may establish different payment deadlines based on the requirements of Service Providers or the nature of the programme. 20.9 Late PaymentIf the Customer fails to make payment by the due date, Sportsmedia Indonesia may provide notice or a reasonable opportunity for the Customer to make the required payment. If payment remains outstanding after such deadline, Sportsmedia Indonesia may take action in accordance with the Booking terms, including cancelling or suspending services that have not yet been secured. 20.10 Cancellation Due to Non-Payment of InvoiceIf the Customer fails to fulfil its payment obligations in accordance with the agreed payment schedule, Sportsmedia Indonesia may cancel the Booking after providing reasonable notice, subject to the rights and obligations of the parties under applicable law. Cancellation charges or non-refundable amounts may apply in accordance with the applicable Booking terms. 20.11 Third-Party CostsThe price may include costs paid or payable to third parties, including:
airlines;
hotels;
transportation providers;
venues;
tour operators;
coaches;
instructors;
sports federations;
educational institutions;
event organisers;
insurance companies; and
other service providers.
Cancellation and refund policies imposed by third parties may affect the amount refundable to the Customer. 20.12 TaxesPrices may or may not include taxes, depending on how the price is stated in the quotation or invoice. Where a particular tax is required to be imposed under Indonesian law, Sportsmedia Indonesia shall charge and collect such tax in accordance with applicable tax regulations. 20.13 Taxes and Charges in the Destination CountryThe Customer acknowledges that certain charges in the destination country may be imposed by the government or local Service Providers. Such charges may include:
local taxes;
tourist tax;
city tax;
airport tax;
visa fees;
immigration fees;
admission fees; or
other mandatory charges.
Where such charges are not included in the Booking price, they shall be the responsibility of the Customer. 20.14 Visa and Immigration FeesUnless expressly stated as included in the Booking, visa fees, entry permit fees, immigration charges, and related administrative fees shall be the responsibility of the Customer. Sportsmedia Indonesia may assist with the administrative process where such services are included in the Booking. 20.15 Additional Services Requested by the CustomerIf the Customer requests additional services after the Booking has been confirmed, Sportsmedia Indonesia may charge additional fees. Examples include:
flight changes;
hotel upgrades;
additional rooms;
additional baggage;
additional transportation;
additional activities;
itinerary changes;
additional participants;
venue changes; or
other special services.
20.16 Changes in Number of ParticipantsChanges in the number of Travellers after a quotation or Booking has been confirmed may affect the price per person. A reduction in the number of participants may result in a higher per-person price where certain costs are allocated based on the number of participants. 20.17 Additional ParticipantsIf the Customer wishes to add Travellers after the Booking has been confirmed, such additions shall be subject to availability. The price for additional participants shall be calculated based on the costs and availability applicable at the time the request is made. 20.18 Changes to Services Requested by the CustomerIf the Customer requests changes to confirmed services, Sportsmedia Indonesia shall inform the Customer of any applicable price adjustment or additional charges where such information can reasonably be determined. The changes shall only be implemented after obtaining the Customer's approval where such changes result in material additional costs. 20.19 Price Changes by Service ProvidersBefore a service has been secured or fully paid to the relevant Service Provider, costs may change due to:
changes in rates;
changes in availability;
changes in taxes;
changes in fuel costs;
changes in exchange rates;
changes in transportation costs;
changes in venue costs;
changes in accommodation costs; or
other factors originating from the Service Provider.
20.20 Price Increases After ConfirmationIf, after the Booking has been confirmed, an increase in costs occurs due to circumstances beyond the reasonable control of Sportsmedia Indonesia, Sportsmedia Indonesia may notify the Customer of such increase. Any price increase must be based on actual costs or relevant cost changes and shall not be applied unreasonably for the purpose of imposing additional charges on the Customer. 20.21 Customer's Rights in the Event of a Material ChangeIf a cost change results in a material change to the total Booking price, Sportsmedia Indonesia shall provide the Customer with reasonable information regarding:
the reason for the change;
the amount of the change;
the services affected; and
the options available to the Customer, if any.
20.22 Price TransparencySportsmedia Indonesia is committed to providing clear and transparent pricing information. Where a cost is known and can reasonably be anticipated at the time a quotation is prepared, such cost shall be included or explained in the quotation where relevant. 20.23 Costs That Cannot Be Determined in AdvanceIn certain circumstances, some costs may not be determined with certainty at the time a quotation is issued. This may occur because:
third-party rates are not yet available;
ticket prices have not yet been released;
currency exchange rates may change;
taxes may change;
government requirements may change;
venue costs may change; or
other factors are beyond the reasonable control of Sportsmedia Indonesia.
In such circumstances, Sportsmedia Indonesia shall provide an estimated cost where reasonably possible. 20.24 Banking and Payment ChargesCharges imposed by banks, card providers, payment gateways, or other financial institutions may be the responsibility of the Customer where such charges have been clearly disclosed before payment. Sportsmedia Indonesia shall not be responsible for charges imposed by the Customer's bank or financial institution. 20.25 Payment by Card or Payment GatewayWhere payment is made by credit card, debit card, payment gateway, or other electronic payment system, the transaction may be subject to the terms and conditions of the relevant payment provider. Sportsmedia Indonesia shall not be responsible for transaction failures caused by the Customer's bank or payment service provider. 20.26 Proof of PaymentThe Customer shall retain proof of payment and invoices relating to the Booking. Sportsmedia Indonesia may request proof of payment where necessary for administrative verification. 20.27 Payment by Sponsor or InstitutionWhere a Booking is funded by:
a sponsor;
a company;
a school;
a university;
a sports federation;
a National Olympic Committee;
a government authority;
an organisation;
a foundation; or
any other third party,
the Customer shall remain responsible for the agreed payment obligations unless Sportsmedia Indonesia expressly agrees in writing that such third party shall be directly responsible for payment. 20.28 Late Payment by Sponsor or Third PartyIf payment from a sponsor or third party is delayed and, as a result, the relevant services cannot be secured or continued, Sportsmedia Indonesia may postpone the affected arrangements after providing reasonable notice. Sportsmedia Indonesia shall not be required to advance third-party costs on behalf of the Customer unless otherwise agreed in writing. 20.29 Refunds to the Paying PartyWhere a refund is approved, the refund shall, in principle, be made to the party that made the payment, unless otherwise agreed in writing or required by law. 20.30 Refunds to ParticipantsWhere a programme is funded by a sponsor, institution, school, university, federation, or other party, a participant shall not automatically be entitled to receive a direct refund where the original payment was made by such party. Entitlement to any refund shall be determined based on:
the party that made the payment;
the applicable agreement;
the funding structure;
the Booking terms; and
applicable law.
20.31 Administrative FeesSportsmedia Indonesia may charge reasonable administrative fees for certain services where such fees have been disclosed to the Customer before the services are provided. Such fees may relate to:
Booking changes;
additional administration;
documentation;
specific administrative arrangements;
additional coordination; or
other administrative services.
20.32 Change FeesWhere a change to a Booking results in charges imposed by a Service Provider, such charges may be passed on to the Customer in accordance with the applicable Service Provider's terms and the relevant Booking conditions. 20.33 Costs Resulting from Incorrect InformationWhere additional costs arise because information provided by the Customer is inaccurate, incomplete, or provided late, the Customer may be responsible for such costs to the extent permitted by applicable law. Examples include errors relating to:
name;
date of birth;
passport number;
travel dates;
number of participants;
visa requirements; or
other material information.
20.34 Costs Resulting from Incomplete DocumentsThe Customer is responsible for ensuring that all required travel documents and other required documents are available and valid. Costs arising from incomplete or invalid documents may be the responsibility of the Customer to the extent permitted by applicable law. 20.35 Promotional PricesSportsmedia Indonesia may offer promotional prices, discounts, special packages, or limited-time offers. Each promotion may be subject to specific terms and validity periods. Unless otherwise stated, promotions may not be combined with other promotions. 20.36 Pricing ErrorsIf there is an obvious error in a quotation or pricing information caused by an administrative or technical error, Sportsmedia Indonesia shall notify the Customer as soon as reasonably practicable after becoming aware of the error. Sportsmedia Indonesia does not intend to be bound by an obvious and unintentional pricing error, subject to applicable law. 20.37 Prices under Contracts or Special AgreementsFor institutional programmes, corporate travel, sports development programmes, sponsorship programmes, education experiences, or large-scale programmes, pricing may be governed by a separate agreement. If there is any inconsistency between these Booking Terms and a special agreement duly executed by the parties, the provisions of the special agreement shall prevail to the extent that they lawfully regulate the relevant matter. 20.38 Pricing for Group ProgrammesFor group travel or institutional programmes, pricing may be calculated based on a minimum number of participants. If the number of participants falls below the agreed minimum, Sportsmedia Indonesia may adjust the price or service structure upon providing notice to the Customer. 20.39 Payment Obligations Do Not Waive Consumer RightsNothing in this CHAPTER is intended to exclude or reduce any consumer rights granted under mandatory provisions of Indonesian laws and regulations. Sportsmedia Indonesia shall administer pricing and payment matters fairly, transparently, and in accordance with applicable law. 20.40 Final Statement on Prices and PaymentThe Customer acknowledges that prices for international travel and programmes may be affected by various factors, including availability, exchange rates, taxes, transportation costs, accommodation, venues, activities, and third-party costs. Sportsmedia Indonesia shall use reasonable efforts to provide clear, accurate, and transparent pricing information and to notify the Customer of any material changes known before such changes are applied, to the extent reasonably practicable. CHAPTER XXICOMPLAINTS AND CUSTOMER RESOLUTION PROCEDURE 21.1 General PrincipleSportsmedia Indonesia is committed to providing Customers with a professional, transparent, fair, and responsive service. If the Customer is dissatisfied with any aspect of a Booking, programme, service, or arrangement provided by or through Sportsmedia Indonesia, the Customer is encouraged to raise the matter so that Sportsmedia Indonesia has a reasonable opportunity to review and, where appropriate, resolve the issue. 21.2 Right to Submit a ComplaintThe Customer has the right to submit a complaint regarding services provided by or through Sportsmedia Indonesia. A complaint may relate to, among other things:
the Booking process;
information provided by Sportsmedia Indonesia;
accommodation;
transportation;
activities;
venues;
programme arrangements;
communication;
administrative matters;
services provided by third-party suppliers; or
any other matter relating to the Booking.
Nothing in this Chapter is intended to limit or exclude any consumer rights available to the Customer under applicable Indonesian laws and regulations. 21.3 How to Submit a ComplaintComplaints should, where reasonably possible, be submitted through the official communication channels of Sportsmedia Indonesia. The Customer should provide sufficient information to enable Sportsmedia Indonesia to understand and investigate the complaint, including where applicable:
Customer's name;
Booking reference;
contact details;
date and location of the incident;
description of the complaint;
relevant photographs, documents, or other evidence; and
the resolution or outcome requested by the Customer.
21.4 Complaints During Travel or ProgrammeWhere a complaint arises during a trip, programme, sporting event, educational experience, or other activity, the Customer should raise the matter as soon as reasonably practicable with the relevant Sportsmedia Indonesia representative, Group Leader, programme coordinator, or designated contact person. Prompt notification allows Sportsmedia Indonesia and, where relevant, the Service Provider to investigate the matter and take reasonable corrective action while the service is still being provided. 21.5 Immediate Notification of Service IssuesWhere the complaint concerns an issue that can reasonably be corrected during the trip or programme, the Customer should notify Sportsmedia Indonesia or the relevant Service Provider without unreasonable delay. Examples may include:
accommodation issues;
transportation problems;
incorrect room arrangements;
missing services;
scheduling issues;
venue problems; or
other service deficiencies that can reasonably be addressed at the time.
Failure to report an issue promptly may make it more difficult for Sportsmedia Indonesia or the relevant Service Provider to investigate or correct the issue while the service is being provided. 21.6 Complaints Involving Third-Party SuppliersWhere a complaint relates to a service provided directly by a third-party supplier, Sportsmedia Indonesia may assist the Customer in communicating the complaint to the relevant supplier. However, the resolution of matters that are directly within the responsibility of the third-party supplier may remain subject to that supplier's own terms, policies, and procedures. Sportsmedia Indonesia will use reasonable efforts to facilitate communication and seek an appropriate resolution where reasonably possible. 21.7 Emergency MattersComplaints involving an immediate threat to the safety, health, or security of a Traveller should not be handled solely through the ordinary complaint procedure. In an emergency, the Customer or Traveller should first seek appropriate emergency assistance and immediately notify the relevant Sportsmedia Indonesia representative or programme coordinator where reasonably possible. Sportsmedia Indonesia may coordinate with relevant authorities, Service Providers, medical providers, venues, or other parties as appropriate. 21.8 Supporting EvidenceSportsmedia Indonesia may request reasonable supporting information or documentation to assess a complaint. Such information may include:
photographs or videos;
receipts;
invoices;
tickets;
booking confirmations;
correspondence;
medical or other relevant documents, where appropriate and lawfully provided; or
other evidence reasonably relevant to the complaint.
The Customer should provide such information where reasonably available. 21.9 Acknowledgement of ComplaintSportsmedia Indonesia will use reasonable efforts to acknowledge receipt of a complaint within a reasonable period after receiving the complaint. The acknowledgement may confirm:
receipt of the complaint;
the person or department handling the matter;
any additional information required; and
the expected next steps, where reasonably determinable.
21.10 Investigation of ComplaintsSportsmedia Indonesia may review the relevant Booking documents, communications, records, supplier information, and other relevant evidence when investigating a complaint. Where appropriate, Sportsmedia Indonesia may contact the relevant Service Provider or other parties involved in the matter. The scope and duration of any investigation may depend on the nature and complexity of the complaint. 21.11 Response to ComplaintsFollowing an appropriate review, Sportsmedia Indonesia will provide the Customer with a reasonable response where practicable. The response may include:
an explanation of the circumstances;
confirmation of corrective action;
an offer of an appropriate remedy, where applicable;
clarification of the applicable Booking terms;
referral of the matter to the relevant Service Provider; or
an explanation as to why the requested remedy cannot be provided.
21.12 Corrective ActionWhere Sportsmedia Indonesia determines that corrective action is reasonably appropriate and within its control, it may take reasonable steps to address the issue. Corrective action may include:
correcting an administrative error;
coordinating with a Service Provider;
arranging an alternative service where reasonably available;
providing clarification or assistance;
reviewing applicable charges; or
taking other reasonable measures appropriate to the circumstances.
21.13 Refunds and CompensationA complaint does not automatically create an entitlement to a refund, compensation, or other financial remedy. Any refund or compensation shall be considered based on:
the nature of the complaint;
the services actually provided;
the applicable Booking terms;
the responsibility of Sportsmedia Indonesia or the relevant Service Provider;
any applicable cancellation or refund policy;
evidence available; and
applicable law.
Nothing in this provision limits any mandatory consumer rights under Indonesian law. 21.14 Complaints Regarding Third-Party ServicesWhere a complaint concerns a third-party Service Provider, any refund, compensation, replacement service, or other remedy may depend on the terms and policies of that Service Provider. Sportsmedia Indonesia may assist the Customer in pursuing the matter with the relevant Service Provider where reasonably practicable. 21.15 Complaints After Completion of the ProgrammeIf a complaint cannot reasonably be resolved during the trip or programme, the Customer may submit the complaint after completion of the relevant service. The Customer should submit the complaint as soon as reasonably practicable and provide sufficient information for Sportsmedia Indonesia to investigate the matter. 21.16 Time Limit for ComplaintsUnless a different period is required by applicable law or specified in a particular Booking, the Customer is encouraged to submit a complaint within 30 days after completion of the relevant service or the date on which the issue became known to the Customer. This administrative timeframe is intended to facilitate timely investigation and shall not be interpreted as excluding or limiting any mandatory statutory rights or legal claims available to the Customer. 21.17 Good-Faith ResolutionSportsmedia Indonesia and the Customer are encouraged to resolve complaints in good faith through communication and reasonable cooperation. Both parties should provide accurate information and avoid unreasonable demands or conduct that may unnecessarily delay the resolution process. 21.18 EscalationIf the Customer is not satisfied with the initial response, the Customer may request that the matter be escalated to an appropriate senior representative of Sportsmedia Indonesia. The escalation request should identify the unresolved issue and explain why the Customer considers the initial response insufficient. Sportsmedia Indonesia will use reasonable efforts to review the matter again where appropriate. 21.19 Mediation and Further ResolutionWhere a complaint cannot be resolved through direct communication, the parties may consider mediation or another appropriate dispute resolution mechanism before commencing formal legal proceedings, where appropriate and permitted by applicable law. Any mediation or dispute resolution process shall be conducted in accordance with the applicable provisions of CHAPTER XXII — GOVERNING LAW AND DISPUTE RESOLUTION. 21.20 No RetaliationSportsmedia Indonesia shall not penalise or retaliate against a Customer merely because the Customer has submitted a genuine complaint or exercised a lawful consumer right. Complaints should be handled objectively and professionally. 21.21 Unreasonable or Abusive ComplaintsSportsmedia Indonesia reserves the right to manage complaints that involve abusive, threatening, discriminatory, fraudulent, or otherwise unlawful conduct. Where necessary, Sportsmedia Indonesia may limit communication to reasonable channels or take other appropriate measures, while continuing to respect the Customer's lawful rights. 21.22 Complaints Made by Group Leaders or RepresentativesFor group travel, institutional programmes, sports development programmes, educational programmes, or other organised activities, Sportsmedia Indonesia may request that operational complaints be coordinated through the designated Group Leader or authorised representative. This does not prevent an individual Traveller from exercising any individual consumer rights available under applicable law. 21.23 Complaints Involving MinorsWhere a complaint concerns a minor Traveller, Sportsmedia Indonesia may communicate with the parent, legal guardian, Group Leader, school representative, or other duly authorised person, subject to applicable law and the circumstances of the case. Sportsmedia Indonesia shall handle relevant personal information in accordance with its privacy and data protection obligations. 21.24 Confidentiality of ComplaintsSportsmedia Indonesia will handle complaint information with reasonable confidentiality and in accordance with applicable privacy and personal data protection laws. Complaint information may be shared with relevant Service Providers, representatives, authorities, insurers, professional advisers, or other parties where reasonably necessary to investigate or resolve the complaint, or where required or permitted by law. 21.25 Record KeepingSportsmedia Indonesia may maintain reasonable records of complaints, communications, investigations, and resolutions for administrative, quality-control, legal, regulatory, or compliance purposes. Such records shall be handled in accordance with applicable data protection requirements. 21.26 No Admission of LiabilityThe acknowledgement, investigation, communication, or resolution of a complaint by Sportsmedia Indonesia does not, by itself, constitute an admission of liability or wrongdoing. Any determination of responsibility shall be made based on the relevant facts, applicable Booking terms, contractual obligations, and applicable law. 21.27 Customer CooperationThe Customer shall cooperate reasonably with Sportsmedia Indonesia in the investigation and resolution of a complaint. This may include providing accurate information, relevant documents, reasonable access to supporting evidence, and timely responses to reasonable requests for clarification. 21.28 Multiple ComplaintsWhere multiple complaints arise from the same Booking, programme, event, or group, Sportsmedia Indonesia may consolidate related matters for administrative efficiency, provided that doing so does not unlawfully restrict any individual Customer's rights. 21.29 Complaints and Consumer ProtectionNothing in this Chapter is intended to exclude, restrict, or waive any mandatory consumer protection rights granted under Indonesian laws and regulations. Where a provision of these Booking Terms conflicts with a mandatory legal provision applicable to the Customer, the mandatory legal provision shall prevail to the extent required by law. 21.30 Final Statement on Complaints and Customer ResolutionSportsmedia Indonesia is committed to handling complaints fairly, professionally, transparently, and in good faith. The purpose of this complaint procedure is to provide the Customer with a reasonable opportunity to raise concerns, enable Sportsmedia Indonesia to investigate and respond to such concerns, and, where appropriate, reach a fair and practical resolution while respecting the rights and obligations of all parties under applicable law. CHAPTER XXIIGOVERNING LAW AND DISPUTE RESOLUTION 22.1 Governing LawThese Booking Terms, any Booking made under these Booking Terms, and the relationship between Sportsmedia Indonesia and the Customer shall be governed by and construed in accordance with the laws of the Republic of Indonesia, unless otherwise required by mandatory applicable law. 22.2 Applicable Indonesian Laws and RegulationsThe parties acknowledge that the Booking and services provided under these Booking Terms may be subject to applicable Indonesian laws and regulations, including, where relevant:
Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer Protection;
Law of the Republic of Indonesia Number 27 of 2022 concerning Personal Data Protection;
Law concerning Electronic Information and Transactions, including its amendments, to the extent relevant to electronic contracts and the use of the website;
the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata), particularly provisions concerning agreements and contractual obligations;
applicable immigration, customs, transportation, tourism, and other regulations; and
other applicable laws and regulations relevant to the Booking or services.
22.3 Contractual RelationshipThe Customer acknowledges that acceptance of these Booking Terms, together with the applicable proposal, quotation, invoice, Booking confirmation, or other applicable Booking documents, may constitute a contractual relationship between the Customer and Sportsmedia Indonesia to the extent provided by applicable law. The rights and obligations of the parties shall be interpreted in accordance with the applicable Booking documents and these Booking Terms. 22.4 Good-Faith ResolutionThe parties shall make reasonable efforts to resolve any complaint, disagreement, or dispute arising from or relating to a Booking through good-faith communication before commencing formal dispute resolution proceedings, where reasonably practicable. 22.5 Direct NegotiationWhere a dispute arises, the Customer and Sportsmedia Indonesia should first attempt to resolve the dispute through direct communication and negotiation. The party raising the dispute should provide reasonable information concerning:
the nature of the dispute;
the relevant Booking;
the facts giving rise to the dispute;
the relief or resolution requested; and
any supporting documents reasonably available.
22.6 Internal EscalationIf a dispute cannot be resolved through initial communication, either party may request that the matter be escalated to an appropriate senior representative of Sportsmedia Indonesia. The purpose of escalation is to provide the parties with an additional opportunity to review the matter and seek a practical resolution before proceeding to a formal dispute resolution process. 22.7 MediationWhere appropriate, the parties may agree to resolve a dispute through mediation before commencing court proceedings or other formal dispute resolution proceedings. The mediator and mediation process shall be agreed upon by the parties. Unless otherwise agreed, the costs of mediation shall be allocated between the parties in a manner agreed before the mediation commences. 22.8 Alternative Dispute ResolutionWhere permitted by applicable law, the parties may agree to use an appropriate alternative dispute resolution mechanism, including mediation or other legally recognised dispute resolution procedures. Where mandatory consumer protection legislation provides a specific right, procedure, forum, or remedy, such mandatory provision shall apply to the extent required by law. 22.11 JurisdictionSubject to any mandatory jurisdictional rights available to the Customer under applicable law, disputes relating to these Booking Terms or a Booking may be submitted to the competent courts of the Republic of Indonesia. Where a specific jurisdiction is required or permitted to be agreed in a separate contract, such jurisdiction may be specified in that contract. 22.12 International CustomersWhere the Customer resides outside Indonesia or the Booking involves international travel, the parties acknowledge that laws or mandatory consumer protection provisions of another jurisdiction may apply in certain circumstances. Nothing in these Booking Terms is intended to exclude any mandatory legal rights that cannot lawfully be excluded.Subject to such mandatory provisions, these Booking Terms shall remain governed by Indonesian law. 22.13 Disputes Involving Third-Party Service ProvidersWhere a dispute relates primarily to a service provided by a third-party Service Provider, Sportsmedia Indonesia may assist the Customer in communicating with the relevant Service Provider. The Customer acknowledges that disputes directly involving the third-party Service Provider may also be subject to that Service Provider's own terms, conditions, dispute resolution procedures, and applicable law. 22.14 Insurance-Related ClaimsWhere a claim or dispute is covered by a travel insurance policy or other insurance arrangement, the Customer may be required to pursue the relevant claim directly with the applicable insurer in accordance with the policy terms. Sportsmedia Indonesia may provide reasonable administrative assistance where appropriate but shall not be responsible for determining or paying insurance benefits unless expressly agreed in writing. 22.15 Sporting Events and Educational ProgrammesFor sporting events, competitions, educational programmes, sports development programmes, international clinics, or other specialised programmes, disputes may also be subject to the rules and regulations of the relevant federation, organiser, institution, venue, or governing body. Where applicable, the Customer shall comply with the relevant dispute resolution procedures established by such body. 22.16 Emergency or Safety-Related MattersNothing in this Chapter prevents the Customer or Traveller from immediately contacting emergency services, relevant authorities, medical providers, venue management, or other appropriate parties where an urgent safety, health, or security matter arises. Emergency assistance shall take priority over ordinary complaint or dispute resolution procedures. 22.17 LanguageThese Booking Terms may be made available in Indonesian and English. Where both versions are provided, the parties may rely on the version expressly designated as the governing version in the relevant Booking or agreement. If no governing language is expressly designated, the Indonesian version shall be used for purposes of interpretation under Indonesian law, to the extent permitted by applicable law. 22.18 Electronic AcceptanceWhere the Customer accepts these Booking Terms electronically, including through the Sportsmedia Indonesia website, electronic booking system, email confirmation, digital form, or other electronic means, such acceptance may constitute valid evidence of the Customer's agreement to be bound by these Booking Terms to the extent recognised by applicable law. 22.19 Evidence of AgreementThe parties acknowledge that electronic records, including booking confirmations, invoices, emails, electronic communications, payment records, digital acknowledgements, and system records may be used as evidence of the Booking and related contractual communications, subject to applicable law. 22.20 Costs of Legal ProceedingsUnless otherwise required by applicable law or determined by a competent court or other authorised dispute resolution body, each party shall generally bear its own legal and administrative costs incurred in connection with a dispute. outstanding payments;
refunds;

intellectual property;

limitation of liability;
dispute resolution; and

The Customer should review the applicable terms and privacy policies of third-party platforms before using their services. 23.32 No Reliance on Unauthorised StatementsThe Customer should rely on official information provided by Sportsmedia Indonesia through its authorised representatives and official communication channels. Sportsmedia Indonesia shall not be responsible for commitments or representations made by unauthorised persons to the extent permitted by applicable law. 23.33 Binding EffectThese Booking Terms shall apply to the parties and, where applicable, their respective lawful successors and permitted assigns.
